Justin McCarthy reports for GallupThree in four Americans (76%) say they have "a great deal" of respect for the police in their area, up 12 percentage points from last year.In addition to the large majority of Americans expressing "a great deal" of respect for their local police, 17% say they have "some" respect while 7% say they have "hardly any."Gallup has asked this question nine times since 1965. The percentage who say they respect the police is significantly higher now than in any measurement taken since the 1990s and is just one point below the high of 77% recorded in 1967. Solid majorities of Americans have said they respect their local law enforcement in all polls conducted since 1965. How about the ethnic breakdown?Four in five whites (80%) say they have a great deal of respect for police in their area, up 11 points from last year. Meanwhile, two in three nonwhites (67%) report having the same level of respect, an…

When a person has been seriously injured, their life changes in many ways. How they live, what they can do, how they interact with their spouse and family, even what they can do for entertainment. While most people understand that part of a compensation lawsuit is to help the injured party recover from these losses, they do not realize how significantly impacted the spouse of the injured party is from the injuries.Loss of Consortium is a claim that is usually filed by the spouse of the injured party seeking compensation for what they have suffered as a result of their spouse’s injuries. Loss of companionship and intimacy, loss of services the spouse provided prior to the injury, loss of income the spouse provided, and even loss of social contact.Consortium is a Latin word and is taken from the phrase: “ per quod servitium et consortium amisit” and is translated as “ in consequence of which he lost her society and service.” What this means is that…

Florida Supreme Court Rejects Dippolito Appeal, Case Set for Second Trial

The high-profile murder-for-hire plot case of Dalia Dippolito is slated for a second jury trial before the end of the year, now that the Florida Supreme Court has refused to hear a request from defendant to toss out the charges. In the matter of Dippolito v. Florida, justices gave no explanation for the denial, saying only it was denied upon review. A circuit judge had denied her dismissal request earlier this year. Florida’s Fourth District Court of Appeal rejected her request without even holding a hearing. The bizarre case out of Boynton Beach has raised all sorts of issues about entrapment and whether the alleged plot was ever real to begin with. According to ABC News, Dippolito is accused of concocting a scheme to kill her former husband when they were just newlyweds. She reportedly, with the help of a friend, helped to hire a “hit man,” who was actually an undercover detective, to kill her husband. Video footage exists of her telling the detective she is…

What happens to deported Central Americans?

Amnesty International’s new report, Home Sweet Home? Honduras, Guatemala and El Salvador’s Role in a Deepening Refugee Crisis, documents the incredible levels of violence and impunity that are driving tens of thousands of people from these countries (known as the Northern Triangle of Central America) to flee their homes and seek asylum in the United States and Mexico. It also investigates what happens to those Central Americans who are sent back to their countries of origin—often without receiving a fair hearing regarding the threats to their lives. Unfortunately, it is not easy to find this information: No official statistics exist to document the number of deported migrants who are subsequently murdered, but news coverage and Amnesty International’s investigation suggests it is not uncommon. An upcoming study by social scientist Elizabeth Kennedy . . . said that a review of local news reports since 2014 showed 83 Central Americans were murdered after…

Does Your Car Insurance Actually Cover Your Drivers?

You get a car, buy insurance, and think you’re covered in the event of an accident. Most car insurance actually does cover any drivers who you permit to operate the vehicle. But a Virginia family was shocked to have coverage denied after their family-business vehicle was wrecked. The problem? The car was titled in the mom’s and dad’s names. The business is owned by the dad and son (NOT the mom). The car was paid for and insured by the business. The mom was driving the vehicle at the time of the accident, taking the dad home from the hospital. The insurance company denied coverage, claiming that the mom driving was outside the policy, since she isn’t part of the business. The appeals agreed. Basically, the title of the vehicle screwed over this family. They had insurance, but they didn’t have all the paperwork in order to make sure that the insurance covered them. The takeaway for anyone with ANY business use of their vehicle is to make certain that…

Alleged Daycare Center Drug Dealers Arrested

Police arresting two drug dealers is hardly worthy of a local news headline these days in Maryland. Crime statistics are dropping in many of the urban and suburban areas statewide, as the number of property and violent crimes are as low as they have been since the 1960’s when the state population was nearly half of what it is today. But drug crimes are not following the same trend, and these offenses are dominating the arrest statistics at most police departments. Controlled dangerous substance arrests occur so frequently that even local media outlets pass on reporting a bust unless the shear size makes it newsworthy, or if a celebrity, public official or law enforcement officer ends up being the arrestee. Occasionally though the facts are so bizarre or alarming that the media outlets pounce on a new drug case, and a recent bust out of Pasadena fits that bill. Last week Anne Arundel County police officers arrested two alleged drug dealers that were suspected to have been…

Restitution Procedure – Using Pleadings Filed by the Victim’s Attorney Restitution Procedure: can the victim of a crime intervene in the criminal case to directly request restitution? In March 2011, Michael brown was charged with several crimes involving sexual conduct with minor L.N. The victim’s counsel sought to enter an appearance for the purpose of asserting a claim for restitution, but the district court denied that request and held that restitution procedure does not allow L.N. to file through counsel because she was not a proper party. The court noted that counsel may speak on L.N.’s behalf where appropriate. Brown pleaded guilty in 2012 to a single count of unlawful sexual activity with a sixteen or seventeen year old. He received a term not to exceed five years, probation, and was ordered to pay an award of restitution to the victim. Restitution was not an exact amount because restitution procedure allowed for it to be determined later. L.N.…

Terror Suspects Lied to Achieve Refugee Status:  Two men with terrorism ties allegedly lied to U.S. immigration officials and continued their terror-related activities after being admitted as refugees, exposing a flawed screening process that is jeopardizing the safety of Americans.  Malia Zimmerman of Fox News reports that Aws Mohammed Younis Al-Jayab, 23, was admitted to the U.S. as a refugee in 2012 but returned to the Middle East twice to fight for a terrorist group, and was later recorded by the FBI talking about executing Syrian Army members and Russian allies.  He is currently being held in Chicago for attempting to support a terrorist group and is facing charges in California for lying about residing in Syria.  Faraj Saeed Al Hardan, 24, the nephew of a famed Al Qaeda bomb maker, moved to Houston in 2009 after living in Iraqi and Jordanian refugee camps, lying to U.S. Customs and Immigration Services to obtain asylum and was granted permanent…

SEC’s 2016 Activity Breaks Enforcement and Whistleblower Records

Earlier this month, the SEC (the “Agency”) announced that it initiated a record-breaking 868 enforcement actions in fiscal year 2016. This figure – along with other milestones – reflect the Agency’s commitment to expanding the scope and reach of its enforcement programs to pursue an array of federal securities law violations. The SEC attributed its record-setting numbers to, among other things, the use of new data analytics to discover fraud, an increased focus on novel and significant actions (such as the Agency’s recent jury trial victory against the City of Miami and its former budget director), and increased attention on attorneys, investment advisers, auditors, and other gatekeepers. The SEC release noted four more record highs. There were 548 standalone or independent actions (or cases initiated by the SEC that were not previously heard in court), 160 cases against investment advisers and investment companies, including 98…
