Fort Lauderdale Burglary Suspect Catches One Break After Another

Last year, a Pompano Beach man was convicted of a slew of burglary and robbery charges. He faced up to 60 years in prison. The judge deferred his sentence in lieu of probation. But then, he was stopped for driving without a license. He was hauled back into court and sentenced to the full 60 years in prison. Following widespread backlash, the Broward Circuit judge had a change of heart. Community leaders at a hearing promised to work with the 24-year-old defendant, Herbert Smith. They were going to help him find a job and keep him out of trouble. The judge agreed once again to suspend the 60-year prison term. The caveat was that any violation of that probation – no matter how minor – could result in that 60-year sentence being reinstated.  Then just before Thanksgiving of this year, Smith was arrested, accused of a burglary that took place in September. He was identified as one of two men who broke into a home in Parkland and heisted…

Trump is no friend of the Bill of Rights and civil liberties and is likely to nominate plenty of candidates for the Supreme Court and lower federal courts who are no champions of civil liberties either. On November 8, 2016,  a Springfield psychiatrist, Duttala Obul Reddy, settled allegations of false billing for services provided to nursing home residents in central Illinois.  The false claims lawsuit filed by the government alleged that from January 2008 through February 2013, Dr. Reddy allegedly submitted bills for evaluation and management services provided at long-term care facilities that either had not been provided or had not been provided to the extent claimed. Under the terms of the settlement agreement, Dr. Reddy denies the allegations that he submitted or caused submission of false claims for payment under Medicare and Medicaid for medical services. The terms of the settlement required Dr. Reddy to pay $908,000 and to agreed to his exclusion from participation in Medicare, Medicaid and all other federal health care programs for a period of 10 years. The settlement had the U.S. District Judge Myerscough enter judgment in favor…

Grits was happy to see Rep. James White's HB 50, making a simple but needed change in Texas statutes surrounding indigency and payment of fines. Looking at the bill language, The East Texas Republican would allow JPs and municipal court judges to waive fines or substitute community service before defendants default  and have warrants issued, instead of afterward. Rep. Grits has remarked in the past that the number of traffic tickets given by Texas law enforcement has precipitously dropped in recent years. Nobody knows for sure the reasons for these reductions in tickets and warrants, though the Austin Statesman has published the most thorough exploration of the topic. But I should have also considered that the number of arrest warrants for Class C misdmeanors has concomitantly declined. A check of Office of Court Administration data this morning confirmed that hunch.In FY 2015, municipal courts issued 1.738 million arrest warrants for Class C misdemeanors, roughly the same as FY 20142 1.731 million and a few more than the 1.667 million in 2013.
