On Friday, long-time Houston state Rep. Senfronia Thompson filed a major piece of police accountability legislation, HB 2044, which expands on the transparency proposal filed in the senate to include new provisions on racial profiling data collection and use of force.Use of Force RevisionsIn the context of high-profile police shootings which have garnered national attention over the last couple of years, perhaps the most important part of the bill would change the statutory authorization to use deadly force when effecting an arrest. Previously, police could shoot someone when effecting an arrest if the suspect's alleged conduct included "the use or attempted use of deadly force," or if there is a "substantial risk" that "the person to be arrested will cause death or serious bodily injury" to someone else.Under Thompson's revisions, in order for a police officer to be justified using deadly force, a suspect must pose an "imminent…

Forensic backlog at DPS due to free lunches for Lubbock, other freeloader PDs

There's no such thing as a free lunch, unless you're a police department in Texas looking for no-cost crime lab services. Then you can call DPS and by law they must provide services for free. The predictable result is a massive backlog. From the new Government Effectiveness and Efficiency Report prepared biennially by the Legislative Budget Board - the one the Lt. Governor didn't want released:According to the Department of Public Safety, from calendar years 2010 to 2015, the crime lab’s forensic evidence backlog increased from approximately 22,000 to more than 33,000 submissions. Among respondents to a 2016 survey conducted by the Texas Center for the Judiciary, 96.2 percent indicated that the wait for lab results had led to court delays. The Department of Public Safety’s crime labs do not have standard procedures to ensure all forensic testing is necessary at the time testing occurs. There is also not a policy that allows the lab to halt…

Your Car Accident Injury May Not Be As Minor As You Think

I had the good fortune of a good meal with friends over the holiday weekend. One young individual struggled with an episode of low back pain.  I was drawn into the conversation because I was aware that this young man had been involved in a very serious car accident the year before.  My cause for concern was his age.  I knew without the proper steps toward a treatment plan including a large amount of rehabilitation and exercise, this young individual would set himself up for a long life of pain. Before becoming an attorney handling personal injury claims, I was a chiropractor and routinely treated these types of injuries.  After treating a large number of individuals injured in car and truck accidents you realize a wide variety of injuries which range from minor to very serious can result from this type of trauma.  The young man I spoke about above was the victim of a high-impact collision and suffered major injuries, but what about the victims of…

Case Illustrates Reality of Non-Citizen Voter Fraud

President Donald Trump has at every opportunity falsely stated that anywhere from three to five million illegal votes were cast in the 2016 presidential election. Neither he nor anyone else in his administration has provided the public, any law enforcement agency, or members of Congress with an iota of evidence to substantiate these reckless allegations. In fact, every legitimate, bi-partisan or non-partisan, study has found real voter fraud to be statistically non-existent.   The president has charged that many of these fraudulent ballots were cast by either “illegal aliens” or aliens not authorized to vote. Again, there has been absolutely no evidence offered that supports that aliens have voted in statistically relevant numbers.   Penalties for Voting Fraud are Steep   18 U.S.C. § 611(a) prohibits “any alien” from voting in a presidential election or any other federal election.   8 U.S.C. § 1227(a)(6) provides for the…

DOJ Order to Baltimore Cops: Fix the Pronoun, Forget the Murder

The desperate need for Jeff Sessions to turn DOJ's Civil Rights Division upside down has never been on more vivid display than in the juxtaposition of the following stories. In the first, we see that, under DOJ's consent decree with crime-ridden Baltimore, one subject of considerable attention is the need for police to use the correct pronoun when they interact with citizens.  PowerLine repeats the relevant portion of the decree:Ensure that BPD officers address and in documentation refer to all members of the public, including LGBT individuals, using the names, pronouns, and titles of respect appropriate to the individual's gender identity as expressed or clarified by the individual. Proof of the person's gender identity, such as an identification card, will not be required. To the best of my knowledge (readers please correct me if I'm wrong), there has not been a single episode of murder, robbery or mugging in Baltimore's 288 year history…

Driver facing criminal charges after alleged attack on passenger

Many different professions require employees to provide services to the public. Uber drivers encounter numerous individuals every day, and these interactions are typically uneventful. However, a single instance that involves a dissatisfied customer can lead to accusations. One driver is facing criminal charges after she allegedly assaulted a pregnant woman in Georgia. The woman had called for an Uber ride and attempted to flag the driver down upon arrival. She claims that the driver did not stop immediately and had an adverse reaction when asked why. The rider then left the car and alleges that the female driver got out, threw her down, and began kicking her in the stomach. The driver was later arrested on suspicion of assault, and her employment with the company was terminated. Charges of this nature can impact a person's life in various ways. Loss of employment can create significant financial burdens, and a successful conviction may lead to other…
