Couple Detained by US Border Patrol After Traffic Stop in Mission Valley

A couple in San Diego, Carlos Nieblas-Ortiz and Martha Valenzuela-Luna, were reportedly stopped by two deputies in Mission Valley for a cracked windshield. They had their two children with them, one of whom is currently a DACA recipient. Once they were stopped, they were turned over to federal immigration officials. Nieblas-Ortiz said deputies never asked them for their immigration status, and did not issue a citation, but they were prevented from leaving.  Instead, deputies called U.S. Border Patrol, and the family was forced to wait over an hour.  Nieblas-Ortiz was released on bail, but he has told Telemundo 20 he is still not sure about whether they will be deported. Mr. Ortiz’s attorney states that his client had presented his license and was not issued a ticket.  Instead, officers called immigration officials on them without informing them what was happening. It was announced in a recent settlement that Gatorade made misleading "anti-water statements" while promoting its sports drinks in a video game played by teenagers. In doing this, Gatorade violated state consumer-protection laws by negatively portraying water in a mobile app that was downloaded by over 2 million users. In the free mobile app, the likeness of the Jamaican sprinter, Usain Bolt, encourages users to keep their performance level high by avoiding water and using Gatorade to fill their fuel meter.The settlement was a $300,000 fine and Gatorade is banned from negatively depicting water in any type of advertising. The video game is now no longer available. A portion of the fine will go towards research on water consumption and nutritional health. A couple of weeks ago, a complaint was filed in the United States District Court (for the Northern District of Georgia) alleging that the three complainants were subject to a violation of their Fourth Amendment rights when they were arrested and held in jail cells for hours all because a police officer trained as a Drug Recognition Expert (DRE) believed they were driving under the influence of marijuana. None of the three ended up testing positive for marijuana. Not only were the complainants’ liberties infringed but as the complaint noted, all three now have a record of arrest, which will stay with them for life and which they will now have to explain to potential employers, landlords, schools and others. The complaint alleges these abuses by the same officer, but the violations alleged against the officer have certainly occurred in other jurisdictions, including California.
