Court Packing

Judge William Pryor of the U.S. Court of Appeals for the Eleventh Circuit has this op-ed in the NYT: A prominent conservative law professor, Steven Calabresi, and one of his former students recently published a proposal to expand the federal judiciary by creating hundreds of new judgeships. A founder and chairman of the Federalist Society (of which I have been a member since 1984), Professor Calabresi promoted his "judgeship bill" as a way of "undoing" President Barack Obama's judicial legacy. But there is nothing conservative -- or otherwise meritorious -- about this proposal.

CARMEN McEVOY Y EL PODER

What the Stepped-Up Basis Means for Inherited Property

The stepped-up basis is a rare “gift” from the IRS that provides favorable tax treatment for inherited capital assets. Real estate, stocks, and other capital assets that have appreciated in value are eligible for the stepped-up basis, which can result in huge tax savings if used properly. Tax Treatment for Capital Assets In simple terms, your basis in an asset is what you paid for it. If you later sell the asset, you have realized a capital gain equal to the difference between your basis and the sale price. If the asset declined in value, you may able to deduct a capital loss. If you’ve been holding an asset for a long time and the value has increased substantially, you might have to pay a significant amount of capital gains taxes if you sell the asset. To avoid this, you might think about giving the asset to someone else, perhaps a relative or friend. However, the IRS doesn’t give you any breaks on gifts of capital assets. The person you receives the…

An Aggravated Drunk Driving Conviction Can Mean Deportation

Drunk Driving Convictions and Potential Deportation A driving under the influence conviction in Massachusetts is a serious thing because it can mean that you will have to pay a fine and face jail time, but you will also establish a permanent criminal record, add points to your driver’s license, and face loss of your driving privileges for some amount of time. Yet another possible consequence of an aggravated drunk driving conviction is deportation from the United States Those criminal defendants who are convicted of a felony level DUI in Massachusetts who do not hold US citizenship may face being deported out of the country as a consequence to their illegal activities. Permanent residents, those who are in the United States on asylum, visa holders, as well as illegal immigrants, can all be stripped of their immigration benefits in the United States if they are convicted of a DUI in Massachusetts. Once an individual is deported from the United States, he or she is often…

Can I Sue My Boss in Connecticut for Giving Me an STD?

Mixing business, romance, and sex can lead to messy situations at your job. Despite all the recent high profile sexual harassment accusations in the news (Matt Lauer, Harvey Weinstein, etc.), having sex with your boss is not necessarily against the law in Connecticut. But as the best Connecticut sexual harassment lawyers and attorneys can explain, when the sex becomes a condition of your employment, it triggers Connecticut “hostile work environment” discrimination and retaliation laws that can protect you and your employment. What makes these cases even messier is when your boss gives you a sexually transmitted disease (an STD) like genital herpes or genital warts. That’s when you may be able to sue your boss and employer for damages… Is Having Sex with My Boss in Connecticut Against the Law in Connecticut? Not necessarily. So long as the sex is consensual, and so long as the sex is not a requirement of your employment, then it may not be illegal or…

Alleged Mishandling of DWI Evidence by New Jersey Law Enforcement Official Could Affect Thousands of Cases

$

In order to convict someone of driving while intoxicated (DWI), New Jersey prosecutors must prove beyond a reasonable doubt that the person was impaired by alcohol or drugs. State law allows police to collect breath samples to test blood alcohol concentration (BAC) in suspected DWI cases. Police in New Jersey typically use a device known as an Alcotest, which analyzes breath samples provided by blowing into a tube. These devices require careful maintenance and calibration in order to produce reliable measurements. In October 2017, prosecutors in several New Jersey counties notified thousands of individuals with DWI convictions or pending charges that police may have mishandled BAC evidence in their cases. A specially appointed judge will determine whether any New Jersey DWI cases should be reviewed in light of this alleged misconduct. New Jersey law creates an incentive for prosecutors to rely on BAC evidence. They can prove that a defendant was legally impaired through…

Medical Marijuana Patients Beware: You May Have a Bulls Eye on Your Car

On January 1, 2014, Medical Marijuana became legal in Illinois. The Illinois Medical Marijuana policy is stricter than most other states that have enacted Medical Marijuana. Illinois does not allow Medical Marijuana to be grown at home. The Marijuana must be cultivated at a state-regulated facility that is under strict rules and regulations. To be allowed to use Medical Marijuana, you must apply for permission from the Illinois Department of Health. The application process is strict and it may take several months for you to be approved. If you are approved to use Medical Marijuana, you will be given an identification card. You will only be allowed to purchase 2.5 ounces of medical marijuana every 14 days. The program is tightly restricted and supervised. While I was investigating how the Medical Marijuana laws have affected the DUI laws in Illinois, I discovered that if you get a Medical Marijuana card, this will be reported to the Illinois Secretary of State and your status as…

Courtrooms Flooded with Litigants With No Lawyers

$

It’s not getting any easier to be a judge these days, as self-represented litigants continue to overwhelm Canadian courts in increasing numbers. With the abolition of Legal Aid and a middle-class that can’t afford to hire lawyers, the situation has become dire. University of Windsor law professor Julie MacFarlane’s research indicates that up to 80% of court users in family law go into court without a lawyer. The popular cliché that people who represent themselves in court have fools for clients has never been more true, and despite the increasing availability of pro bono legal services, rarely does free legal advice mean that a lawyer will show up in court. While it is lawyers that have the reputation for talking too much and wasting court time, the truth is that court cases with lay litigants take up many more court hours because rules of evidence and procedure, while somewhat relaxed for in-person litigants, must still be maintained to ensure due…
