Everyone can agree that DWI/DUI is a national problem, accounting for thousands of traffic-related deaths and injuries. In response, many states have strengthened laws related to DUIs, especially for repeat offenders. Since states began enacting stronger DUI legislation, between 1982 and 2015, DUI-related fatalities decreased 57 percent. While this is, indeed, a positive effect, drunk […] The post The Strictest and Most Lenient DWI Laws by State appeared first on Minneapolis DWI Lawyer Douglas T. Kans.

Idaho State Police news release For Immediate Release, Feb. 13, 2018 Contact: Tim Marsano, ISP Public Information Officer, 208.884.7122 News release: Scam on Sex Offender Registrants The Idaho Central Sex Offender Registry, administered by the Idaho State Police, has been made aware of several attempted scams targeting registered sex offenders in at least one Idaho county and six Florida counties. One scam involves a caller posing as a law enforcement officer who tells the sex offender that they have missing or out-of-date registration information. The caller then threatens that, in order to avoid arrest for failure to register, the registrant must bring a gift/money card to a specified location (other than the registration office). The caller may provide a callback number with a voice mail message that sounds as if it belongs to the local law enforcement agency's registration office. In another report, the caller says they are with the sheriff's office and they…

Illegal Busted With $560,000 of Meth:  An illegal alien who had been deported three times last year was caught with seven kilos of methamphetamine in November and is facing trial on drug trafficking charges.  David Neal of the Miami Herald reports that Saul Bustos and Irepan Salgado rolled into Florida with the meth, planning to sell most of it to a contact at an IHOP in Hialeah.  The buyer had contacted Salgado's brother to set up the deal.  The problem was, the buyer was an undercover drug agent.  After the deal went down, both men were arrested and face 10-years-to-life in federal prison if convicted.  Bustos, who admitted illegally crossing the U.S. border on April 13, 2017, and again on July 6th and 19th, faces additional time.

Last month, the Innocence Project was in court to request DNA testing in the 1998 conviction of Renay Lynch, who was sentenced to 25 years to life in prison but has long contested that she is innocent and was coerced into falsely confessing to being an accomplice to the murder of her 82-year-old landlord. Today, Lynch’s fight for new DNA testing was examined in two stories as part of a collaboration between the Marshall Project and WNYC’s the Takeaway. In the radio episode, reporter Andrew Cohen and Innocence Project Staff Attorney Susan Friedman, one of the lawyers representing Lynch, spoke about Lynch’s case. According to Friedman, the only evidence that was presented against Lynch at her trial in 1998 was her confession, which, she testified, she immediately recanted after she was outside of police custody—along with testimony from a jailhouse informant who said that Lynch confessed to her. DNA testing at the time was rudimentary, explained Friedman,…

After allegations of sexual harassment and assault came out against movie mogul Harvey Weinstein, the #MeToo movement went viral, sparking new levels of social awareness regarding power and sex. High profile men in the political, business and entertainment realms have been accused of “sexual misconduct” — but what does that mean, exactly? With the rise of allegations there has also been increasing backlash against the #MeToo movement, mostly because people do not understand what exactly these men are being accused of: is it a criminal act, a civil violation, or just abhorrent behavior? Some cases may involve all three while others, like the Aziz Ansari story, fall within the realm of gross behavior. Sexual Misconduct Media outlets commonly used the term “sexual misconduct” when reporting accusations made against these high profiled men and women. But sexual misconduct is not a legal term. It does not actually refer to a…

An affirmative defense allows a defendant to avoid legal responsibility for the charged offense. When a defendant uses an affirmative defense, the defendant is admitting guilt. However, the affirmative defense provides an excuse or justification for why the action transpired. An affirmative defense has the ability to mitigate the legal consequences of an unlawful action. Affirmative defenses include the following: Insanity Mistake of Fact Mistake of Law Intoxication Duress Entrapment Age Insanity as an Affirmative Defense One of the hardest defenses to prove, and one of the most misunderstood, affirmative defenses in Texas is the affirmative defense of Insanity. While our firm has successfully mounted insanity as a defense, it remains an elusive defense. The insanity defense exists because there are times when we as a society have decided that the person should not be held responsible for that action. The most common justifications have been codified as…

Cada una de las ramas del Poder Público tiene sus funciones propias, pero los órganos a los que incumbe su ejercicio colaborarán entre sí en la realización de los fines del Estado. De…
