What You Need to Know About Medical Malpractice

When you are sick or injured, you trust doctors, nurses, and other healthcare workers to care for you. The responsibility that medical professionals have to their patients is like no other profession. When a hospital or medical professional makes a mistake, the results can be catastrophic. Tragically, medical mistakes and negligence are increasingly prevalent problems that leave thousands injured or killed every year. Medical Errors Now Account for a Staggering Number of Deaths The Latin phrase “Primum non noceere” which means, “First, do no harm,” is often recited by physicians as a promise to uphold their responsibility to keep patients safe from injury. Unfortunately, this promise is not always kept. Most people are aware that there are instances when medical professionals fail to do the job they have a sworn duty to do but have no idea how prevalent the problem really is. The Journal of the American Medical Association reports that medical…

LAW ENFORCEMENT MISCONDUCT RECORDS ARE SHIELDED FROM THE PUBLIC

Recently New York Public Radio station WNYC profiled an in-depth investigation on police misconduct in the New York Police Department. The investigation revealed hundreds of incidents of misconduct by NYPD officers, including stealing and assaulting New York City residents. The investigation revealed that some of the officers were found to use excessive force by internal affairs, others of firing their gun unnecessarily, and that is just a sampling of the offenses the internal affairs department of the NYPD found officers committed. Most of these officers did not lose their job and many are still on the beat. Sometimes officer misconduct can ruin an innocent person’s life. For example, recently a New York Police Department officer was convicted of fabricating drug evidence. His false evidence sent an innocent man to prison. Another NYPD homicide detective, once renowned for his investigation skills, is accused of tampering with evidence, prompting the district attorney to…

Driving under the influence is most commonly associated with younger drivers under the influence of alcohol, but if you are a regular reader of this blog, you know that unlawful DUI includes not only driving under the influence of alcohol but also driving under the influence of drugs, both legal drugs (including prescription drugs) and illegal drugs. Driving under the influence of drugs is becoming an increasingly dangerous occurrence on our roads and highways. According to the Center for Disease Control and Prevention (CDC) drugs (legal and illegal) account for 16% of all motor vehicle crashes. The National Institute of Drug Abuse (NIDA) estimates that 11% of fatal vehicle crashes involved a driver under the influence of a drug or drugs. With our aging population, another fact must be addressed: older adults are more likely to be taking prescription drugs that may affect their ability to drive safely. This is a sensitive topic that hasn’t received much attention. The…

"Equity" Before Security

Many people express concern for inmates in our jails and prisons these days.  If the concern were genuine, one would expect it would include calls for sufficient discipline to protect inmates from assault.  Yet I don't hear that expressed often; more often we hear the opposite.Rafael Mangual has this article in the City Journal with the above title.  The subtitle is "Mayor de Blasio's soft-on-crime approach is backfiring."Beginning in December 2014, Bill de Blasio's mayoral administration placed significant restrictions on how New York City corrections officers can penalize and restrain violent criminals in city jails, ostensibly to ensure the safety and well-being of inmates and guards alike. But the mayor's policies seem to have made jails less safe for all concerned, as an examination of the data regarding inmate violence reveals. In 1998, when more than 17,500 prisoners were packed into New York City jails on any given day,…

MOTIONS GRANTED

We present to you today the collected wisdom and rulings of former REGJB Judge, and rapidly becoming a legal legend- Judge Hanzman. In the first order, Hanzman vacated a fifty-year sentence on a PVH for a new arrest of a defendant in a car in which a gun was found under the passenger's seat. Represented by a well-respected attorney who was forced into a PVH by Judge Rebull when he was not ready to proceed, Judge Hanzman found that the lawyer's performance was "an outlier" to his long and distinguished career. DNA evidence not introduced excluded the defendant as a contributor to the DNA on the weapon. In the second order, Hanzman vacated a conviction after trial in which there was only one eyewitness and the defense failed to impeach that eyewitness on the grounds that the eyewitness at the time of the trial, the eyewitness was in custody and facing a life sentence on an armed robbery charge. Woops! Giglio anyone? The Third Order deals with…

Appellate Court Rules Part of Illinois DUI Law Unconstitutional

When a motor vehicle crash results in severe injuries or death, one or more of the drivers will likely get a traffic violation ticket, and may even be charged with a more serious crime such as DUI, Aggravated DUI, reckless driving, or even reckless homicide. If the police suspect that a driver was under the influence of alcohol or drugs at the time of a crash, officers must act quickly to obtain proof of that, via chemical testing of the driver’s breath, blood, and/or urine. Speed of action is necessary because the body metabolizes alcohol to an undetectable level in a matter of hours and some drugs in just a couple of days. Illinois Laws Governing DUI Testing In Illinois, the police must follow specific procedures in order for DUI tests to be admissible in court. In particular, Illinois law requires the police to give drivers a standard warning prior to conducting chemical tests for DUI, which informs the driver that he may refuse to submit to testing. If a driver…

It seems like a weekly occurrence, but our beautiful state is under siege from yet another significant snow storm. We cannot stress enough how serious this type of weather can be, especially for your well-being. Snowstorms can cause school closures, power outages, and car accidents when the roads get slick. But, slip and fall injuries tend to get overlooked. Why? Because they aren’t news headline grabbers, but they should be. Slip and fall injuries don’t affect large groups of people in most cases. Usually, it involves one person who suffered only minor injuries. With all of this snow eventually turning into ice after it begins to melt, New Jersey residents should be on the lookout for slick spots with every step they take. Slipping on the snow and ice can cause an assortment of injuries with varying ranges of severity. These injuries can include: Bruises, bumps, and cuts Soft tissue injuries, sprains, and ligament/tendon tears Head injuries Broken bones Spinal cord…

What Is the Difference Between Drug Trafficking and Drug Dealing?

$

Drug crimes are always serious. Anyone who has been charged with any kind of drug crime should work with an experienced drug offense lawyer, as the penalties for drug crimes can be extremely harsh. Furthermore, many drug crimes are prosecuted in federal court, which means they are subject to the federal sentencing guidelines. Additionally, the penalties for drug crimes under Texas law are also severe. Many people wonder if there is a difference between dealing drugs and trafficking drugs. The short answer is that there is no specific crime in Texas called “drug dealing.” Rather, an individual can be charged with a variety of drug-related offenses. The punishments under state law depending on how much of the drug the person possessed, as well as what type of drug was involved. Drug abuse is a serious problem in the United States. According to the National Institute on Drug Abuse, there were about 24.6 million illegal drug users in the U.S. in 2013 — an…

Winkler on Corporations and Their Quest for Civil Rights

I haven't posted in a while, partially because work is busy, but also because I have been making more time for recreational reading (a hobby that can be difficult to pursue when one is an associate in the field of civil litigation). But I've somehow managed to get some reading done recently, so partially to highlight some darn good books (and partially to dilute the frequency of posts fixating on ordinances banning "distracted walking"), here's the first of a couple posts on what I've been reading!First up is We the Corporations: How American Businesses Won Their Civil Rights by Adam Winkler. I bought the book partially because I was a student at UCLA Law and had the opportunity to take one of Professor Winkler's classes, and partially because I read Winkler's previous book, Gunfight: The Battle Over the Right to Bear Arms in America a few years ago and thought it was excellent.Winkler's We the Corporations, like Gunfight, showcases…
