What is Intimate Partner Sexual Violence?

April is Sexual Assault Awareness Month, and that means it’s time for the Law Offices of Anthony Carbone to put an extreme focus on domestic violence awareness. But first, you should know that domestic violence can lead to incidents of sexual assault occurring; especially within an intimate relationship setting. The term you are going to need to know is Intimate Partner Sexual Violence (IPSV). This type of violence includes all forms of sexual assault that take place in a current or past intimate relationship, regardless of a marital status. It typically involves using force, threats, or coercion to obtain sex and/or sexual favors. IPSV also involves shaming another’s sexual preference, along with ignoring or invading their sexual privacy. IPSV rarely transpires on its own, as it usually occurs alongside other forms of abusive behavior. Women are more often than not the victims of this type of sexual violence. Partners, male or female, use this type of abusive…

The Role of Brady Cases

$

Criminal cases in the United States frequently involve one side carrying the burden of presenting evidence in support of its argument before a decider of fact like a judge or jury. One noticeable exception to this structure exists in the case of Brady v. Maryland, which is why people who are interested in federal criminal appeals should understand the rules of this case and its application in deciding future court cases. The Court’s Decision in Brady In the Brady case, the Supreme Court ruled that the due process clause requires the prosecution to turn over all evidence that is exculpatory or favorable to the defendant. The Supreme Court in later cases defined the exact boundary and scope of this case, which resulted in the court finding that prosecutors are required to hand in evidence to the court that directly exonerates a person as well as evidence that weakens the prosecution’s case. If the prosecution fails to obey these requirements, they can be charged with…

A judge in France has ordered the former French president, Nicolas Sarkozy, to stand trial on charges of corruption and influence-peddling, a French official said on Thursday. The charges against Sarkozy are related to allegations that he tried to illegally obtain confidential info from a magistrate judge several years ago. The charges are just the latest legal challenge for Sarkozy. He had already been ordered to stand trial in another case regarding the financing of his 2012 presidential campaign. Sarkozy is also under formal investigation for allegedly receiving funding from the Libyan government of Col. Muammar el-Qaddafi for his 2007 campaign. During the investigation, investigators discovered wiretaps of phone conversations between Sarkozy and his lawyer, Thierry Herzog. The wiretaps revealed that Sarkozy and Herzog had discussed ways of obtaining confidential information regarding the case on whether his 2007 campaign was being illegally funded. The case was being tried…

Does United States v. Ying Expand the Knowledge Requirement for “Classical” Insider Trading?

$

On March 14, 2018, the SEC and DOJ sued Jun Ying, a former Chief Information Officer within an Equifax Inc. business unit, for insider trading. Specifically, they accused him of knowing about a significant Equifax data breach prior to its public disclosure and, while in possession of that material nonpublic information, exercising his Equifax options and selling those shares. When Equifax subsequently announced the data breach its stock price fell, giving Ying a loss avoided of over $117,000. This fact pattern, were that all there is, seems a rather straightforward, uncontroversial application of the “classical” theory of insider trading. Under that theory, a corporate insider, such as Ying, violates Section 10(b) and SEC Rule 10b5 by trading in the company’s securities “on the basis” of material nonpublic information about the corporation. Chiarella v. United States, 445 U.S. 222, 230 (1980); United States v. Newman, 773 F.3d 438 (2d Cir. 2014)…

Yesterday, New York Times columnist Charles M. Blow published an op-ed in response to the shooting of Stephon Clark and the epidemic of police shootings of unarmed black men across the country. Blow points out that tragically, these shootings have become commonplace in America because we have a racially biased criminal justice system in which “[c]ertain people, in certain communities, are viewed as more of a threat more quickly.” Two weeks ago, 22-year-old Clark was fatally shot eight times by two Sacramento police officers in his grandmother’s backyard. Police were responding to a call about someone breaking into vehicles when they came across Clark, firing 20 shots at him. No weapon was found on Clark, only his cellphone. Clark’s death sparked outrage across the country, where anti-police violence protests have become commonplace. While policy reforms, such as better training and requiring officers to wear body cameras, can have an impact, these…

New York Firearms Law and Second Amendment Firm, Tilem & Associates has filed three legal actions, two in New York State Supreme Court and one in Federal Court in Manhattan alleging that the New York City Police Department Licensing Division uses factors in licensing decisions that disproportionately deny African-Americans gun licenses.  In one outrageous case, the NYPD admitted to using false arrests, two arrests for which the NYPD was sued and ultimately settled, as part of the  basis for revoking pistol licenses from an African-American. The NYPD Licensing division is the division within the NYPD that is responsible for issuing and renewing pistol licenses in the City of New York, and has the authority to limit, suspend or revoke a handgun license subject to review by the New York State Supreme Court. In February 2017, during a hearing at the NYPD License Division offices before an NYPD hearing officer, a Detective assigned to the investigation section of the…

Tesla Self Driving Fatal Crash in California

On March 23, 2018, a self driving Tesla SUV crashed while the vehicle was operating on autopilot in Mountain View, California. According to a spokesperson for Tesla, Walter Huang, 38, a software engineer for Apple, did not have his hands on the steering wheel for approximately six seconds before the fatal crash occurred. Tesla maintains that its “autopilot” system can brake, accelerate, control speed, change lanes and self-park, but does require that the operator must keep his or her eyes on the road and hands on the steering wheel so that they can control the vehicle to prevent accidents. Tesla contends that in the March 23rd accident, Mr. Huang took no evasive measures to prevent the Model X SUV from colliding with a concrete divider. This despite allegedly receiving “several visual and one audible hands on warning earlier in the drive”. Photographic evidence shows that the front of the SUV was destroyed, the roof torn from the car and the front wheels…

….But the officer didn’t read me Miranda….

Anybody that has watched a television show or movie with police offers is familiar with Miranda warnings.  They are the warnings that advise an individual that they have the right to remain silent and that any statements made by them can be used against them in court.  Even though Miranda warnings have been around for more than 50 years, people are still confused about when they are required to be read and what exactly the warnings cover.   Is Miranda Required? One of the many misconceptions perpetrated by television shows is that Miranda warnings are required before a police officer can arrest someone.  This is incorrect.  An officer can arrest you and charge you with a crime without ever reading you your Miranda warnings.  Miranda warnings are only required if a police officer is going to question you about a case and you are in custody.  Both of those requirements must be met, otherwise no warnings are…

Illinois Appeals Court Holds Officer Need Not Readvise DUI Defendant of Implied Consent Law Before Blood Test

After failing field sobriety tests, an Illinois defendant was arrested for DUI. At the police station, an officer read the defendant the required admonitions, and the defendant submitted to a breathalyzer test, showing his blood alcohol content was within the legal limit. Then, the officer requested that the defendant submit to blood or urine testing. The defendant refused, and his driver’s license was suspended. He filed a petition to rescind the suspension, which the trial court denied. He appealed, arguing that his petition should have been granted because the officers (1) lacked a reasonable suspicion to request blood or urine testing and (2) failed to issue him a second warning before requesting blood or urine testing. In a case relevant to all Illinois DUI law, this fall, the Illinois Court of Appeals for the Third District affirmed. At the hearing, the Shorewood police officer testified that while on patrol at around 1:12 a.m. on April 4, 2016, he observed the…

Illinois Appeals Court Holds Dog Sniff Unreasonably Prolonged Traffic Stop

The State of Illinois appealed from the lower court’s granting of three co-defendants’ motions to suppress contraband found following a dog sniff of their car. This fall, the Illinois Court of Appeals for the Second District held that the dog sniff violated the Fourth Amendment because the traffic stop was illegally prolonged. This case’s analysis of the Fourth Amendment is relevant to Illinois DUI law. The three defendants were charged with armed violence, unlawful possession of heroin with the intent to deliver, and unlawful possession of heroin. The defendants moved to suppress the evidence seized from the car that defendant 1 drove and in which defendants 2 and 3 were passengers. One afternoon in November 2015, an Illinois officer noticed a car with Minnesota license plates closely following a tractor-trailer. In addition, some of the car’s windows were tinted heavily. Thus, the officer effectuated a traffic stop. Continue reading →
