What is Deferred Entry Of Judgement In Orange County, CA?

$

If you’re charged with a misdemeanor crime in Orange County you may be eligible for a program that is currently being utilized by the Orange County District Attorney’s Office.  This program is the Deferred Entry Of Judgement Program or DEJ.  Not all misdemeanors are eligible but if yours is, or your attorney can convince the District Attorney’s Office that yours should be, you can have your case eventually dismissed. The DEJ Program requires that you plead guilty with a continuance of your sentencing while you submit to a DNA test, are fingerprinted, photographed, complete a one or two day life skills class and not get arrested for 90 days.  Your DNA sample does go into the “system” and can be used against you if your DNA ends up at a crime scene in the future.  However, if you do all of the above you can withdraw your guilty plea and have your case dismissed 90 days after your plea is entered.  Of course, if you do get…

Protecting the Flores Settlement

On June 22, pursuant to Trump's Executive Order, the Department of Justice asked a federal court to let the government out of some of the Flores settlement requirements. This binding settlement is the only law preventing the horrific caging of children apprehended by ICE.Why? So that our government can efficiently detain families together in preparation for deportation. The Justice Department's "motion," asks for two "narrow" exceptions to the Flores settlement. First, to be able to detain families together. Second, to make family jails exempt from licensing requirements, which govern the minimum standards of care in these jails. Here's what you need to know:1. It is based on the false narrative that American immigration policies incentivize Central Americans to flee to the United States and "game" the system by filing weak or fraudulent asylum claims. Who says so? Thomas Homan, soon-to-be-ex director of ICE. Homan is a virulent…

Plea Bargaining May Be No Bargain – Consult A Defense Attorney

$

A substantial number of criminal cases that are prosecuted in Florida result in some type of conviction by way of a plea bargain. As noted by the American Bar Association, this typically involves prosecutors offering a deal that allows the defendant to plead guilty to a lesser crime than what was originally charged. However, many of these are not truly “bargains” at all. A dedicated, experienced criminal defense attorney should carefully weigh whether you might be better served taking the case to trial. If not, he or she should be skilled and adapt at the plea bargain negotiation process. The issue with the plea bargain process is that, as noted in a recent analysis by The Atlantic, innocence isn’t always relevant to the outcome – particularly if you don’t have a good lawyer defending you. Approximately 94 percent of state-level criminal felony convictions and 97 percent of federal felony convictions are the result of a plea bargain. Estimates for…

If you are, or were, a member of the United States military and suffering from trauma related to your service, you may be eligible for a pre-trial diversion program if you get a DUI. Penal Code section 1001.80 allows a court to suspend prosecution on misdemeanor charges if the defendant may be suffering from PTSD, or other mental health problems related to the defendant’s military service. Specifically, the trauma as delineated in the statute includes: Sexual trauma; Traumatic brain injury; Continue reading →

PROSECUTORIAL MISCONDUCT IN CALIFORNIA

$

I have previously writtenon these pages about the alleged prosecutorial misconduct by the Orange County District Attorney’s Office—misconduct that made national headlines. That incident prompted the California Legislature to introduce and enact a new lawthat that punishes California prosecutors who tamper with or withhold exculpatory evidence. Prosecutorial misconduct is a problem across our nation’s criminal courts. I don’t mean to imply that all district attorneys’ offices are in the business of intentionally hiding or manipulating exculpatory or exonerating evidence, but it’s enough of a problem to be concerned. Sometimes the life of an innocent person is on the line because of—to put it charitably—overzealous prosecution. Take the case of John Thompson. In 1984, he was convicted ofrobberyand murderin Louisiana. He was sentenced to death. Fortunately for Mr. Thompson, Louisiana is not a state quick to execute death row…

USCIS Suspends Expedited Processing of H-1B Visas

U.S. Citizenship and Immigration Services (USCIS) recently announced that although it would begin accepting petitions for H-1B visas subject to the Fiscal Year (FY) 2019 cap, it also was suspending premium processing for all FY 2019 petitions subject to the cap, including those petitions seeking an exemption for individuals with a master’s degree or higher. However, USCIS will continue to accept premium processing requests for H-1B visa petitions that are not subject to the cap during this time period. It is unclear when USCIS will reinstate premium processing of the H-1B visa petitions subject to the cap. According to USCIS, suspending the premium processing of these visa petitions will help reduce overall H-1B visa petitions processing times. The agency claims that the temporary suspension will allow it to process long-standing petitions that it previously has been unable to process due to the influx of petitions, and particularly those seeking premium processing, as…

On Sunday night a woman reportedly drove 19 miles reaching high speeds with her ex-boyfriend hanging onto the hood of the vehicle. She is facing charges for the allegations. Around 10:00 p.m. on June 24, 24-year-old Patresha Isidore, and her ex-boyfriend, Junior Francis, who share a residence and a child was in the middle of an argument when Isidore decided that she wanted to leave and pick up their 5-year-old daughter from a family member with whom the child was visiting. In an attempt to prevent Isidore from backing out of the driveway and departing in the blue Mercedes that she and Francis also co-own, he mounted the hood of the vehicle. Though Francis still had his body atop the front of the vehicle Isidore is accused of pulling out and driving off while knowing that Francis was still holding on. Continue reading →

I Was Hit by a Car While Crossing the Street – How to Get Compensated

$

It was a day like any other day. You get to a busy intersection and hit the crossing signal, and patiently wait for the “walk” signal that tells you the close is clear. After a bit of a wait, you finally see the white outline of a person flash across the street from you and you begin to cross the street. On the periphery of your vision, you see a blur speeding towards you, but it is already too late. Before you know it you are struck by a speeding vehicle, and now are in serious pain. Now what? Contact The Law Offices of Elliott Kanter at (619) 330-5881  to schedule a free consultation today. Compensation for Damages If you suffer damages, be them physical, psychological, or another type of damage, you should receive compensation. The compensation will allow you to get the medical attention you need, covering any expenses stemming from the accident. While you clearly did nothing wrong and deserve compensation, collecting a claim can get a little…

Heterodox Academy Has No Vulgarian Auxiliary

As those of you who follow me on the twitters may be aware, I chide Jon Haidt’s love-child, Heterodox Academy, for not letting me be a member of the club. Of course, it’s a club of academics, so why would they? I’m no prof, and what could I possibly do to aid in their mission to provide cover to diversity of thought in academia? My joke is that they need a Vulgarian Auxiliary (for the unwashed, that’s a play on the “Ladies Auxiliary” to men’s clubs of old) with my being a practitioner rather than a scholar, hence vulgarian. If you don’t get the joke, i can’t help you. Or at least I don’t want to, you joyless tool. But if you insist on reading further, at least try to grasp that it’s humor. The @HdxAcademy held its first ever conference recently. It was attended by some of the most brilliant voices promoting diversity of thought around. I was not invited. I wasn’t asked to sit on a panel. I wasn’t…

Time For A Hoe Down

It’s really quite sweet that the New York Times is willing to give of its precious real estate to the sad musings of children, though this particular one involves a word in its headline that few have ever heard before, and fewer still have reason to mention. Taken literally, the term “hoejabi” refers to women who see themselves at the crossroads of being “hoes” and “hijabis.” If you’re not a Muslim woman, don’t even think about using it. https://t.co/Vkv46VLjWL by @romaissaa_b — NYT Opinion (@nytopinion) June 29, 2018 Is it fair to call this peak New York Times, a headline that includes a word that no one else is allowed to utter? How to Be a Hoejabi The NYU junior who wrote about her inner and outer conflicts is remarkably normal, but for the fact that she’s going through the questions of identity that most people resolve before they graduate from high school. We all have doubts about who we are, who we want to…
