Tis the season for giving - and also for taking. Theft in its various forms inevitably spikes during the holidays, when more opportunities present themselves. From retail theft to package theft to identify theft - there is always more of it in December and January. Law enforcement agencies have responded to this by initiating special operations to target such offenders, particularly those involved in organized retail crime. For example, "Operation Holiday Steals" was a three-day sting involving partnerships with the Broward County Sheriff's Office, local police, U.S. Homeland Security, the U.S. Secret Service and some two dozen large-scale retailers, including Target, Walgreens, Macy's and Sports Authority. Mortgage Fraud Blog. Jonathan L. Herbert, 36, Lighthouse Point, Florida, has been charged with wire fraud for conducting a home loan modification scam that targeted individuals who were having difficulties making their mortgage payments. During a hearing before United States District Judge David R. Herndon, Herbert pled guilty to the fraud charge contained in the criminal information. According to the information, Herbert conducted his fraud scheme from a strip mall office located in Fort Lauderdale, Florida. Herbert usually contacted his victims through unsolicited telephone calls, introducing himself as a “federal loan officer” with the “Federal Debt Commission,” the “Federal Mortgage Marketplace,” or the “Federal Assistance Program.” Herbert used these names and titles in order to deceive the victims into believing that his fraudulent program was operated and approved by the federal government. Mortgage Fraud Blog. Juan Ramon Curiel, 36, Visalia, California, pleaded guilty to conspiracy to commit mail fraud and bankruptcy fraud in connection with a foreclosure rescue scheme he orchestrated. Curiel’s co-defendant and business partner, Santiago Palacios-Hernandez, 45, Salinas, California, pleaded guilty to the same conspiracy charge. According to court documents, Curiel and Palacios-Hernandez operated Star Reliable Mortgage, with offices in Bakersfield, Visalia and Salinas. Between August 2010 and October 2011, Curiel and Palacios-Hernandez conspired to defraud homeowners and lenders by offering clients a purported “loan elimination” program that would enable homeowners to own their homes “free and clear” of any loans or mortgages. Curiel and Palacios-Hernandez charged clients upfront fees ranging from $2,500 up to $4,500 and additional monthly fees and told their clients to stop paying their mortgages. USEPA Announces 2014 Annual Environmental Enforcement Results

On December 18, 2014, the USEPA released its annual enforcement and compliance report.  According to the report, in fiscal year 2014, the USEPA criminal program generated $63,000.000.00 in fines and restitution, secured $16,000,000.00 in court-ordered environmental projects and sentenced defendants to a combined 155 years of incarceration. A DuPage County couple was arrested and charged in early December with two counts each of burglary, and additional counts of retail theft, for allegedly stealing and selling more than $4,000 worth of merchandise from a string of DuPage County Walmart stores. The charges are Class 2 and Class 3 felonies, respectively. Police allege the couple stole and later sold the items to feed their drug addiction. We’re going to look north today, to Idaho, for insight into the often misunderstood arena of Los Angeles DUI blood tests. In an Idaho Supreme Court decision on December 3, 2014, a judge ruled that police must get a warrant before performing a DUI blood test if a suspect refuses to give blood or perform other sobriety tests. Former Idaho Supreme Court decisions have stated that a warrantless blood law is permissible under an “implied consent statute.” However, 1st District Court Judge Benjamin R. Simpson reversed these decisions based on two local cases in which men suspected of DUI had their blood drawn to test for alcohol under protest. Cases such as the McNeely case of 2013 — as well as Judge Simpson’s two most recent decisions — cite the fact that “the natural metabolization of alcohol in the bloodstream does not alone present an urgent need [for a blood draw],” according to the Spokesman-Review. The island’s ominous history as a military fortress, high security prison, and refuge for persecuted indigenous people is steeped in oppression, an emotion that fully engulfed us as we set off towards the @Large exhibit. As we walked through the old, dark and damp dilapidated buildings, with their grey cracked walls and broken windows, Ai Weiwei’s intention to relay oppression and imprisonment upon the viewer was reinforced. However, through his work Ai Weiwei has transformed Alcatraz Island from a symbol of oppression and fear to one of freedom of expression and activism. Our visit to Alcatraz was in conjunction with Amnesty’s Write for Rights campaign, so it was of no surprise that one of the most emotional and powerful parts of the exhibit for all of us was…
