Roy Welsh, age 71, of Caldwell, Idaho was driving a 1979 Dodge Ram Charger. Welsh was parked westbound on Homedale Road hooking up a jump box in an attempt to get his vehicle started. The vehicle started while in gear, leapt forward and Welsh became pinned against the curb by his vehicle. Welsh's vehicle then proceeded to travel across the grass in front of Vallivue High School and came to rest in front of the school, after striking a cedar tree. Welsh succumbed to his injuries at the scene of the crash. Notifications to Welsh's family have been made. This crash is under investigation by the Idaho State Police. -------------

North Andover Man Charged With Possession Of Marijuana With Intent To Distribute

Erik Lang, 20, was arrested for possession with intent to distribute marijuana on February 27th after a traffic stop in North Andover. Police allegedly stopped Lang after learning that his license was suspended. Further investigation revealed that Lang had there-quarters of a pound of marijuana with him. Police told the local newspaper that the amount indicates that Lang had the marijuana for “more than personal use.” Lang has been charged with driving after license suspension, possession with intent to distribute marijuana, and possession of marijuana. Contrary to what the police officer suggested to the newspaper, quantity of drugs is far from dispositive on intent to distribute. There are a number of indicia considered in assessing whether there was an intent to distribute drugs. Factors considered include: the packaging of the drugs; presence of paraphernalia associated with distributing drugs, such as scales, plastic baggies and cutting agents; presence of large amounts of cash; and multiple cell phones. Lack of intent to distribute is a common, and often viable, defense in these types of cases. As a Massachusetts drug crimes defense lawyer, I’m interested in the nature and extent of the “investigation” that followed the stop. There have been important legal search and seizure developments in the context of marijuana-related searches ever since possession of one ounce or less of marijuana became a civil, as opposed to criminal, offense in Massachusetts. Depending on the facts and circumstances of the encounter, Lang might have solid grounds for a motion to suppress evidence. I’d also be interested in whether there were other occupants of the car, whether this defendant owned the car, and the location of the alleged marijuana. These factors are important in considering a lack of possession defense. For example, if the car did not belong to this defendant and the alleged drugs were in the trunk or under a seat, he might be able to argue that he did not know that the drugs were in the car and that he did not have control over the drugs. Some tend to forget that possession of more than an ounce of marijuana is still a criminal offense in our Commonwealth. Here, it seems inappropriate that the defendant is charged with both possession and possession with intent. When the Commonwealth charges two drug violations , the specific controlled substance supporting each charge must be a “separate item” or “separate unit of prosecution.” In this example it appears that both the possession and possession with intent charges are based on the same item.

String of Strong Armed Robberies Leads to Arrest of Five Suspects in East Lansing

A string of strong armed robberies that occurred on Sunday February 17 between the hours of 1:30 a.m. and 3 a.m. have led to the arrest of five individuals, one of them a juvenile. The robberies took placed in Cedar Village and the Valley Neighborhood according to a news report at MLive.com. The five suspects were arrested by East Lansing Police on March 1. The juvenile was not named, but the adults suspected in the robberies include 17-year-old Davion Dashawn Scott, 17-year-old Dallas Ledesma Benitez, 18-year-old Nicholas Marlon Jackson, and 18-year-old Rodricus Delmere McDuffy. All four of the men are from the Lansing area. According to Lt. Scott Wriggelsworth, the five suspects were in a vehicle and would approach individuals walking on the streets, asking for directions or change. Upon the victim stopping, the men would then "strong arm" or assault the individual, then steal his or her possessions. The suspects were stopped a short time later at the Linden-Bailey intersection after police were given descriptions of the suspects and their vehicle. According to Lt. Wriggelsworth, there were eight victims all total and five robberies at various locations; a few of the victims were said to have suffered minor injuries. The suspects were arrested following the robberies, but were released after processing for further investigation. The four adults were formally charged on March 1, each charged with five counts of unarmed robbery, one count of home invasion, one count of conspiracy and one count of assault with intent to rob. Unarmed robbery is a serious criminal offense. Michigan unarmed robbery attorneys understand the harsh criminal penalties individuals face if convicted, and the urgency in hiring an experienced lawyer to protect against those penalties.

31-year-old Convicted Burglar Pleads Guilty to Rape and Robbery, Faces 20-48 Years in Prison

William Harrison, a 31-year-old convicted burglar, recently pleaded guilty to first-degree criminal sexual conduct, armed robbery, and home invasion according to a news report at CBS Detroit. The alleged rape and robbery occurred in 2011, and involved an 80-year-old woman who was allegedly attacked in Clinton Township at the Heritage Estates senior citizens' complex where she lived. News reports state that Harrison pleaded guilty to the charges one day prior to his scheduled trial. He is scheduled to be sentenced on April 1. Michael L. Steinberg, Harrison's defense lawyer, and a Circuit Court judge agreed on sentencing of between 20 and 48 years in prison. According to police, the defendant entered the woman's apartment through an unlocked window; the crime occurred at around 11:15 p.m. as the woman was sleeping. The woman testified in court that Harrison said his daughter had been kidnapped, and that he needed ransom money. She alleged that Harrison locked her in the bathroom after ordering her to open a safe in a closet, where she had stored personal documents, pain medications, and jewelry. The woman (who was not named) then claimed that Harrison ordered her back into the bedroom, where he raped her as she screamed for him to take her belongings and leave. News reports indicate that Harrison has an extensive criminal record and was on probation in two different courts when he was arrested for this incident; no prior arrests involve assault, however. First-degree criminal sexual conduct is an extremely serious charge, as all Michigan sex crime attorneys know. Individuals who are convicted may spend up to life in prison; obtaining positive results requires the skill and experienced of a talented lawyer. A conviction can ruin a person's life, not only in terms of losing his or her freedom, but being labeled as a sex offender forever.

GEORGE ZIMMERMAN TO WAIVE STAND YOUR GROUND HEARING

George Zimmerman, the admitted killer of Trayvon Martin, an unarmed teenager in Sanford Florida will forego his right to a “Stand Your Ground” hearing next month, his legal team announced, Tuesday. Under Florida’s Stand Your Ground law a defendant who claims self defense is entitled to a pretrial hearing before a judge to determine the validity of a self defense claim. If the judge finds the self defense claim valid the case is terminated and the defendant is absolved of guilt. If the judge does not absolve the defendant, he/she still has the to a self defense claim at trial. While I believe, that as a matter of public policy Zimmerman should be tried before a jury, which will presumably hear the evidence of self defense, I am somewhat befuddled when I try to understand the defense strategy in waiving a hearing. If there was a hearing and a judge decided to dismiss the case all havoc may break loose. The case has achieved a fair amount of notoriety. It is seen as a case where the police and the District Attorney initially refused to charge the White killer of an unarmed African American teenager. The racial overtones are clear. It is likely that if a white judge dismissed the case on “stand your ground” grounds that riots would break out in major cities around the country. Faith in the American system of justice and due process will suffer another strike. Tremendous pressure would be put on Florida to abrogate the stand your ground statute. But as a legal strategy it has advantages. It basically gives Zimmerman two bites at the apple. First he gets to argue self defense at a hearing before a judge and if he loses he gets a second opportunity before a jury. Its hard to figure out why Zimmerman would surrender one of his two bites. Perhaps he is afraid that if the case is dismissed by the judge that he will never be able to live down the fact that he killed Martin. There have been threats on his life already and he may be afraid that those threats will continue for the rest of his life if a judge, without a jury, dismisses the case. Although he gave a statement to the police, Zimmerman may have some surprise testimony. If his lawyers do not think that the case will be thrown out at a stand your ground hearing, they may not want Zimmerman to testify before trial and expose his surprise testimony. Or perhaps they do not want to subject the surprise testimony to cross examination prior to trial. Certainly, if he testifies we can expect serious cross examination by the prosecutor. If under cross examination he is unable to tell the same story twice (once at the stand your ground hearing and once at the trial), he will lose his credibility before the jury. It is certainly a big risk on the part of Zimmerman and his attorneys. We will have to wait and see what is up their sleeves. But you can be sure that there will be plenty of comments made after the trial regardless of whether he wins or loses regarding this move. If he wins, it will be interesting to hear the comments of his lead lawyer, Mark O’Mara.
