The National Highway Traffic Safety Administration (NHTSA) recently released pedestrian accident statistics for 2013. According to the data, in 2013, there were a total of 4,735 pedestrian accident fatalities across the country. There were also an additional 66,000 pedestrian injuries in traffic crashes.The total fatality toll in 2013 was a drop of from 4,818 deaths in 2012. In 2013, pedestrian fatalities accounted for 14 percent of the 32,719 traffic accident fatalities overall. That was also the third consecutive year in which pedestrian loss of life accounted for this percentage of the total toll.In fact, one of the most disturbing facts that emerges from the data is that pedestrians have been accounting for a larger and larger slice of the total number of motor vehicle accident fatalities in the country over the past decade. Judge says St. Johns County went too far, allows couple charged with growing pot to go back to home and collect belongings

A judge ruled St. Johns County should not have immediately condemned the home rented by a couple now charged with growing marijuana.  The judge ruled this week the couple could return to their home for two weeks to gather personal items, as well as the fish living in seven aquariums that may or may not still be alive after not being tended to in a month, according to a report in the Florida Times-Union. The couple was arrested in February, charged with possession of marijuana, possession of equipment used to manufacture drugs and producing marijuana. All three of these St. Johns County Drug Crimes Charges are third-degree felonies punishable by up to five years in prison, meaning both are facing up to 15 years in prison if convicted. The important point to note in this St. Johns County Drug Crimes Case is the defendants have only been arrested and charged. Neither one has been convicted of any crime. Ford Announces Car That Can Prevent Your Next Speeding Ticket

Ford of Europe has announced a new technology that could help you avoid that next speeding ticket. Its new S-max car reads speed limit signs with a camera mounted on the windscreen. The car then adjusts its speed to stay within the confines of the speed limit and will slow down your car if you are driving too fast. The new technology, known as Intelligent Speed Limiter, controls the amount of fuel delivered to the engine rather than pressing on the breaks to slow down the car. The technology may be turned on and off and pressing firmly on the gas will temporarily override the system. This may mean that in the future, speeding tickets will be obsolete. Ravens Release Bernard Pierce Following DUI Arrest

Baltimore Ravens running back Bernard Pierce was charged with DUI last week after he was stopped for speeding in Baltimore County. The team released Pierce later in the day. Baltimore County police claim an officer stopped a Ford Mustang that was speeding around 2 a.m. ET Wednesday in Towson, just north of Baltimore. According to a police spokesman, Pierce had been driving 55 mph in a 30mph zone, and then allegedly failed a series of field sobriety tests after he was stopped. Pierce was taken to a station house in Towson for processing, and later released. Pierce is charged with driving under the influence of alcohol, driving while impaired by alcohol and two additional speeding offenses. This is not the first run in with the law that the Ravens have had recently. Five Ravens players were arrested last year, most notably running back Ray Rice for domestic violence. Evidence-Based Sentencing, Minus the Evidence

"Evidence-based" sentencing is one of the catch-phrases of the sentencing reform movement.  I have never been able to figure out exactly what it means (my experience as an AUSA was that evidence has always been considered at sentencing), but I think it means that sentencing should be based on facts.OK, good, if that's what it actually means.  That idea was, as Kent has pointed out (cf. his comment on this thread), one of the main selling points of Prop 47 in California.  Prop 47 reduced sentencing for a number of drug and property offenses simply by re-classifying them as misdemeanors.  The theory, or so we were told, was that judges would be given more leeway to impose "flexible" sentences, and that this would help reduce crime.Now that, in the wake of Prop 47, property crime (and violent crime) has exploded in the Golden State, however, the refrain is that it's, ummm, too early to pay attention to the evidence.And no, I…

On Thursday, your correspondent testified before the House Select Committee on Emerging Texas Law Enforcement Issues on behalf of the Texas Criminal Justice Coalition for a pair of bills which suggested alternatives to having local District Attorneys prosecute cases of serious police misconduct. HB 1369 by Harold Dutton would create a special unit at the Attorney General's office to prosecute police misconduct cases, taking them away from local District Attorneys who must worry about the consequences of indicting officers who are witnesses in their cases, not to mention political backlash from police unions or other elected officials. HB 1840 by Ron Reynolds would address the same issue by appointing a special prosecutor, or as envisioned in the committee substitute, appointing a prosecutor from a neighboring county. Our Pembroke Pines and Hollywood juvenile defense attorneys at the Law Offices of Leifert & Leifert know that the prosecution's decision to drop criminal charges against the Pembroke Pines teens who uploaded nude pictures of other minors is an important one. Last month, we wrote about this case in its infancy; as you may recall, three juveniles were arrested for uploading naked photos of fellow juveniles to an account on the social networking app Instagram. In other words, they were arrested on suspicion of sharing child pornography on the internet. This week, as we noted above, prosecutors handling the case decided that the three teens would be better suited in therapy and community service than they'd be facing criminal charges. Specifically, the teenagers will be partaking in a juvenile diversion program.
