Leilani Richards, 36, of Boise, was travelling eastbound in a 1991 Jeep Cherokee. The Jeep hit the safety barrels then the cement barrier. The vehicle rolled and came to rest on its wheels in the lane of travel. Richards was transported via ground ambulance to St. Alphonsus Regional Medical Center in Boise; she was wearing her seatbelt. A common question I am asked during the initial consultation with potential clients is why the officer focused on the client’s vehicle before pulling them over and ultimately charging them with a DUI.   Most officers are trained using material based on research conducted by the U.S. Department of Transportation National Highway Traffic Safety Administration, also known as NHTSA. Bederman to represent a group of American military veterans in litigating against a federal statute -- the Uniform Service Former Spouses' Protection Act (USFSPA) --that undid a United States Supreme Court ruling that protected veterans' retirement pay from being divided with ex-spouses in divorce court.       Although I was named lead counsel by the group that organized this litigation effort, David prepared and drafted our court filings -- with my reviewing and always agreeing with them -- and handled all but one in-court argument, which made sense considering his excellent experience and abilities for this litigation. The penalties for a first offense DUI in Kentucky, within a given five (5) year period, are as follows: Penalties Expect to pay a fine of $200 to $500 plus DUI service fees, treatment program fees, county fees, state fees, library fees, and court costs. Based on the county of the DUI conviction, expect the total fine and fees to typically range between $718.00 to $1,058.00. While serving time in jail may not be required on a DUI first offense, based on the facts, the court may sentence the offender to 48 hours to 30 days in the county jail.  Note that in some counties community labor of 48 hours to 30 days may be substituted for the fine or time in jail.
