Cultural Influence On Crime

One can take many different stances when asked to determine the causes of criminal activity. One area of research that has been gaining popularity views crime as a product of the culture or subculture to which one belongs, rather than strictly blaming it on individual differences. In other words, enculturation plays an important role in the development of criminal behavior; this argument is supported by recent research that will be further discussed, and the disparity in rates of crime between different cultures and subcultures. The purpose of this post is to examine any relevant statistics regarding the differences in violent and nonviolent criminal activity within and between cultures, and to discuss the various theories that have been proposed to explain the reason for imbalance in rates of crime around the world. Variations between the type of crime committed, as well as how it is committed will also be noted as it relates to the topic. Beginning with an analysis of a…

We look to our local and state police force to protect our things from burglars and vandals but what about when our assets are being seized by the police themselves? State and federal laws not only condone seizing of assets by our local law enforcement agency, they encourage it. Francis Pusok and Walter Scott Illustrate the Continued Need to Preserve the Right to Film

As if the recent current events surrounding Eric Garner and Michael Brown were not enough, this month saw two more high profile cases detailing police misconduct and brutality which made national news.  In South Carolina, the tasering and shooting of Walter Scott occurred as he was running away from the police was shot on a cell phone by a bystander named Feidin Santana.  In our own San Diego, a local NBC affiliate chopper captured the brutal beating of Francis Pusok in the desert.  Both instances would not have come to light had a third party not captured it with a camera. As the public’s trust in police dwindles, citizens are taking matters into their own hands by increasing their use of cellphone recordings as a means to advance some accountability.  As police begin to feel more uneasy about this increased use of cell phone and camera recordings, many citizens are finding themselves in hot water for recording their own interactions with police, or…

A Hernando County detention deputy has been placed on administrative leave without pay pending the outcome of an investigation after he was arrested, along with his girlfriend, in an alleged illegal narcotics transaction. The man, 41, has been charged with possession of a controlled substance. His girlfriend, 23, was also charged with possession of a controlled substance as well as possession of paraphernalia. According to the sheriff’s office, the investigation started after they received a tip that a Hernando County detention corporal may be involved in illegal drug activity. Police claim they conducted a thorough investigation by arranging  a controlled narcotic transaction, using a confidential informant. Deputies said the informant was solicited by the man’s girlfriend to sell 10 Oxycodone (30 mg.) tablets to her. Heather MacDonald Pulls Back the Curtain on Criminal Justice "Reform"

In her New York Post column, "The Perilous New Push to Excuse Lawlessness," Heather MacDonald brilliantly sums up the racial demagoguery actually at work under the guise of criminal justice "reform":[A] wide-ranging movement is already under way to transform the criminal justice system in order to avoid a disparate impact on blacks. This push will jeopardize the country's two-decade-long crime drop. The pretext for the current decriminalization movement is the half-dozen highly publicized deaths of blacks in encounters with police over the past nine months, including the recent case of Freddie Gray in Baltimore....The criminal justice pendulum is swinging against personal responsibility and toward the use of race and poverty as an excuse for noncompliance with the law....[A] two-tiered system of justice that winks at lawlessness when it is committed by officially favored victim groups will make life miserable for the millions of law-abiding residents of…

Hillary Clinton, David Dinkins, and the Perfect Irony

Time reports a major policy address given by Hillary Clinton.  Its article starts:Hillary Clinton called on Wednesday for broad criminal justice reform and renewed trust between police officers and communities, reflecting the former first lady's evolution from supporting the policies instituted by her husband two decades ago...In part of her speech, Ms. Clinton said (emphasis added):It's a stark fact that the United States has less than 5 percent of the world's population, yet we have almost 25 percent of the world's total prison population. The numbers today are much higher than they were 30, 40 years ago, despite the fact that crime is at historic lows.I will save for a later post any discussion of the mind-bending density of that remark.  For now, I want to focus on this line in the Time piece:Clinton planned Wednesday's speech in November, months before she announced her candidacy, according to former New York Mayor David…

Once cases are passed to the courts, conviction rates are 99 per cent and Gardner's lawyers…

High BAC DUI Charges in Michigan

$

This will be a short article about the role of your BAC (breath or blood test result) in a Michigan drunk driving charge. Just about everyone knows that, a few years back, Michigan adopted a "High BAC" or "super drunk" law. Everyone arrested for a DUI learns, for better or worse, that the enhanced charge kicks in with a breath or blood test result of .17 or higher. Many people, however, do not know that the high BAC offense itself can only be charged in a 1st offense DUI case. In other words, if a person has a prior conviction for a drinking and driving offense within 7 years of the date of the arrest for a new charge, he or she cannot be charged with a high BAC crime. This is significant because the reality is that there are plenty of people who, for reasons beyond our current discussion, pick up a 2nd or 3rd offense DUI charge, and then worry (needlessly, as we'll see) that there is some kind of enhancement or "extra" penalty that can…

No One Should Get Away With Torture

Professor Noam Chomsky (photo: Donna Coveney) This is an American Torture Story. Majid Khan was at the mercy of CIA interrogators for 1,200 days — at least. During that time, he was stripped. He was forced into ice water baths. He was “hung up” for a day in a sleep deprivation position. He was denied solid food for seven days. After about a year, Majid Khan went on hunger strike to protest the treatment he was receiving. The CIA responded with “involuntary rectal feeding and rectal hydration.”  Majid’s lunch tray, consisting of hummus, pasta with sauce, nuts, and raisins, was “pureed” and “rectally infused.” This happened repeatedly. Eventually, Majid Khan attempted to cut his wrists.  I’m interested in the power of words.  Terms like “enhanced interrogation” or “rectal feeding” are clever disguises for the true term we should be using to describe the CIA’s treatment…

Abundance of Caution Sometimes Understandable Regarding Driver’s License Reinstatement

$

In the state of Michigan, someone who has his/her driver’s license revoked for multiple DUIs or other reasons faces an uphill battle when it comes to getting the license reinstated. Why is it so difficult, and why, in most cases, does someone whose license has been revoked have to go through the complicated process of a DLAD (Driver’s License Appeal Division) hearing? The fact is, most who have their license suspended or revoked for driving under the influence will do it again – in the opinion of state lawmakers, anyway. The government is cautious primarily because it does not want to put innocent people’s lives in danger. This is sometimes understandable, considering one recent incident in which a 61-year-old Battle Creek woman had just had her license reinstated and one day later crashed into an ambulance, resulting in the deaths of three individuals. Shirley Stokes, the woman who had her license reinstated the day prior to the accident, ran a red…
