Instead of raising taxes or charging higher fees for services, the police hand out a great many St Louis traffic tickets. Once these tickets are finalized (either by you pleading guilty to it, or having an attorney handle it for you), the muni will end up assessing a fine of somewhere between $100-$300. I could probably end this blog with the above paragraph (because that describes in a nutshell how things work), but it is also worth mentioning how the whole process works. When you receive a St Louis speeding ticket, you will be given an opportunity to simply sign the back of the ticket and mail in the associated fine. But if you go that route, you are in essence pleading guilty to the ticket. If you plead guilty to the ticket, the state of Missouri will assess a number of points (usually two (2)) to your permanent driving record. …

Circuit Court to Review Montana Innocence Project Shaken-Baby Case

A Montana Innocence Project client’s homicide case will be reconsidered by a circuit court, according to a ruling Tuesday by the state Supreme Court.  Robert J. Wilkes will get another chance to contest his 2009 homicide conviction in relation to the death of his 3-month-old son. According to Great Falls Tribune, Wilkes claims his trial lawyer provided ineffective counsel by failing to present any witnesses during the trial and neglecting to have the autopsy report reviewed by another medical examiner. Montana Innocence Project attorneys presented testimony from pathologists and pediatricians who claim the child had a hemorrhage caused by either a mildly traumatic birth or a rare liver disorder. Both conditions present effects similar to abusive head injuries, the lawyers said. State prosecutors argue that the head injury is consistent with shaken-baby syndrome. They claim the injury could only have occurred while Wilkes was watching his son. Wilkes is currently…

Following up on Bill's post, it really is too bad that C&C doesn't have its own server, because I would very much like to use one of these.  We don't do ads on this blog, but I will tell you where to get this one.The statute Bill referred to is the one involved in the Supreme Court's "fish overboard" case of last term, Yates v. United States.  See this post.Yates limited the reach of the statute regarding "tangible objects" to those which "record or preserve information," not including fish, but that won't help Mrs. Clinton.  Emails and the servers that hold them are squarely within the statute as interpreted by Yates.Playing dumb about what it means to wipe a server is about as convincing as the immigrant who speaks fluent English until the questioning gets tough and then suddenly can't understand a word.

Montgomery, Alabama Court Reversed on Child Support Calculation

This is an appeal from Montgomery County, Alabama regarding child support in the case of Farquhar.  The parties were married and originally divorced in 2011.  The father was ordered to pay child support in the amount of $1,050 per month to the mother.  It does not appear that an Income Withholding Order was originally entered in the case. In 2012, the mother filed a petition of contempt and for an Income Withholding Order to be entered in the case.  At a hearing of the matter, the father did not submit to the court a CS 41 Income Affidavit.  The Court found the father in contempt for failure to pay child support and reduced the amount to $704.55 per month plus $94.45 in arrearage. The mother appealed the order and the Court of Civil Appeals reversed the trial court’s order.  First, the father did not submit a CS 41 Income Affidavit.  The appellate court held that it was impossible for the court to determine the child support without…

Man Accused of Asking Preteen Girls for Sex Online

Clay County investigators arrested a 32-year-old Jacksonville man Friday that they claim made fake online profiles posing as a boy to lure preteen girls into having sex. The man is charged with using a computer to solicit a child for sex, transmission of material harmful to a minor and making harassing telephone calls. Deputies have accused him of contacting two female preteen victims and trying to persuade them into having sex. Investigators claim the man admitted to making several fake online profiles, pretending to be a boy, then used those profiles to solicit young girls for sex — both online and on the phone. According to the warrant against the man, one victim told investigators the man asked her for sex and for nude pictures of her via Facebook. She also alleges that he made a lewd phone call to her, according to the warrant. Although domestic violence can have a profound impact on its victims, the effect on those accused of committing violent acts is often ignored, even if that individual has not been found guilty by a jury of his or peers. A Georgia man was recently arrested after allegedly becoming involved in a domestic violence dispute with his ex-girlfriend. When police arrived on the scene, they arrested the man on criminal trespassing and assault charges. It is not clear how long the two had been broken up when the 33-year-old man supposedly made threats of violence against his ex. The woman claims that he showed up at her home at around 10 p.m. after they had engaged in an argument over the phone. There were children residence at the time, and the woman told police that the man had been smoking and using vulgar language, so she told him that he was not a welcome guest at their home. Thanks to a few helpful readers, I learned about a very interesting split panel ruling today from the Michigan Court of Appeals in Michigan v. Skinner, No. 317892 (Mich. Ct. App. Aug. 21, 2015). Here is how this majority opinion starts in Skinner: This case presents a constitutional issue of first impression as to whether the Sixth Amendment mandates that a jury make the findings set forth by Miller v Alabama, 576 US ___; 132 S Ct 2455; 183 L Ed 2d 407 (2012) as codified in MCL 769.25(6), before sentencing a juvenile homicide offender to life imprisonment without the possibility of parole.  We find that the Sixth Amendment mandates that juveniles convicted of homicide who face the possibility of a sentence of life without the possibility of parole have a right to have their sentence determined by a jury.  In so finding, we expressly reserve the issue of whether this defendant should receive the penalty of life in prison without the possibility of parole for a jury.…
