Am 12. August 2015 hat der Bundesrat die Vernehmlassung zur Umsetzung der Motion Pelli (13.3728) eröffnet. Die Vorlage sieht vor, dass Maklerprovisionen aus der Grundstückvermittlungen zukünftig am Wohnsitz bzw. Sitz der vermittelnden Person besteuert werden. Von der geplanten Regelung wird sich daher auch ein reduzierter administrativer Aufwand versprochen. Die neue Regelung dürfte aufgrund des interkantonalen Steuerwettbewerbs aber auch zu neuen Steuerplanungsmöglichkeiten führen. Nach geltendem Recht werden Maklerprovisionen stets am Grundstücksort besteuert. Diese Regelung gilt sowohl für natürliche als auch für juristische Personen. Letztere Regelung wurde jedoch erst aufgrund bundesgerichtlicher Rechtsprechung angewandt. In der Praxis bedeutet dies für Makler, welche Liegenschaften in mehreren Kantonen vermitteln einen erheblichen Mehraufwand, da sie in mehreren Kantonen eine Steuererklärung einreichen…

As often happens, the initial report on the attack on the French train was incorrect in a few particulars.  It looks like four people heroically stopped this apparently terrorist attack:  two American servicemen, one American civilian, and one Frenchman. Sam Schechner and Julian E. Barnes report for the WSJ:Authorities praised two U.S. military members and their friend who tackled and subdued a man armed with guns and a box cutter on a Paris-bound train Friday as it sped through Belgium, breaking up what could have been a deadly terrorist attack. There are some decent things to be said about St. John’s Law School. My pal, John Q. Barrett, teaches there, and maintains the Jackson List, of which I think very highly. But then, there was its handling of David Powers, which was an unmitigated disgrace. Note that they didn’t just dismiss him from St. John’s after taking his tuition for three semesters, but rescinded his admission, as if he was never there.  At this moment, it’s likely weighing heavily that they went far beyond the offense of conviction, deep into the crevices of all bad acts he committed during his drug addiction.  And Powers, believing these four deans to be people of good will, likely expected at least understanding, if not some degree of grudging respect for what he accomplished.  And what he accomplished was nothing short of magnificent.
