Illinois Gives Four-time DUI Offenders a Second Chance

Last month, Governor Bruce Rauner and the Illinois General Assembly decided to give four-time DUI offenders – whose licenses were permanently revoked under former state laws – a second chance. Recent data from the Illinois Secretary of State’s office suggests the law will effect 5,085 drivers, 55% of whom live in the Chicago metropolitan area. Under the new law, which becomes effective on January 1, four-time DUI offenders can apply for restricted driving permits, enabling them to drive in specific circumstances, such as going to work, driving their kids to school, or visiting the doctor. The law only applies to those whose licenses have been revoked for at least five years. Additionally, applicants must prove that they’ve been sober and that they’ve equipped their cars with breath ignition interlock devices, which prevent their cars from starting if they’ve consumed alcohol. Eligible drivers will be overseen by one…

The Maryland police officers who are defendants in the Freddie Gray trial just won what could be a big legal victory, even though their trials are a long way off. The court recently granted a request by the officers to have their cases tried separately. Putting aside the facts of the Gray case specifically, the ruling gives us an opportunity to consider the benefits of trying cases separately when there are multiple defendants. Can Defendants Get Separate Trials? Many crimes involve more than one perpetrator, and there can be multiple defendants charged with one particular crime. We tend to assume that they all will be tried together, in one trial, even if they are each charged with a different crime. Generally, doing that makes sense. If witness will be the same and physical evidence will be the same, why have two separate trials just because there may be two separate defendants? Sept. 30, 2015), held that defendant, a shareholder and corporate executive, did not have a reasonable expectation of privacy in his employees' offices, employees' computers, or the electronic files located on the company's network server, as required to challenge the search and seizure of the corporate offices.Defendants Nagle and Fink were co-owners and executives of concrete manufacturing and construction corporations specializing in state highway construction and mass transit projects. The defendants devised and executed a scheme to defraud the United States Government by obtaining subcontracts set aside for disadvantaged business enterprises (DBE). Darkens Bonnett (hereinafter the “Defendant”) is a gent who stands charged and convicted of first-degree murder. Well, at least he was. The Defendant’s case has been remanded back to trial court to deal with a problem regarding discovery. The Supreme Judicial Court found prejudicial error in his case upon reviewing the appeal. The issue had to do with a criminal defendant’s right to discovery.. allegedly exculpatory discovery. In this case, the discovery had to do with the identity of an informant and his apparent statement to the FBI that another individual, not the Defendant, had actually committed the murder. The judge who denied the request for disclosure gave two reasons. Perhaps one of the most prestigious appointments in Canada is that of a provincial Lieutenant-Governor, appointments made by the Governor-General of Canada in consultation with Canada’s Prime Minister and the Premier of a particular province. The Lieutenant-Governor performs various ceremonial duties on behalf of Queen Elizabeth, while elected politicians and those appointed carry out the daily operations of government. It is a non-partisan position although politicians have been appointed and Canada prides itself on the appointment of women and minorities. "Deja Vu, all over again." I don't mean for that quote from the late Yogi Berra to be humorous here. I'm talking about yet another mass shooting, this time in Oregon. Ten people killed, seven wounded. For me, as Massachusetts criminal defense lawyer, one of the scariest things about this latest massacre, is this: Here in Boston, this story didn't even make the Headline on the front page of yesterday's Boston Globe. It was on the front page, but it wasn't the headlined story: Another, local story did. That's how common and relatively un-shocking this type of violence has become. And once again, the pro-gun control/gun rights advocates will begin the shouting sessions and the finger-pointing at each other. The script never changes; it likely never will. Our country and its elected officials must get beyond this tired, cyclical debate marked by catch phrases such as "Guns don't kill people, people kill people," and…

New York’s chief judges like to leave their mark on the system before they leave the job. Sol Wachtler’s mark was to distinguish New York’s greater respect for constitutional rights despite the Supreme Court’s watering down of federal constitutional rights. Judy Kaye was all about making jurors feel more comfortable about the burden, including eliminating exceptions for all the people who would love to be on a jury, but rarely get picked. Jonathan Lippman ages out in December, and has chosen his cause: to end the bail disaster that leaves the poor in jail for lack of a thousand dollars, particularly when there is no good reason to hold them in the first place.  It’s a worthy cause, even if it could have been accomplished swiftly under New York’s existing law.
