Car of the Future Designed to Detect Sobriety in an Instant

Today,  if the government of Minnesota wants to restrict your ability to start your car once you have consumed alcohol, it can do so under certain circumstances after being charged with a DWI and prior to a conviction. A drunk driving conviction, again in certain instances, may allow the court to order installation of an ignition interlock device as part of an defendant’s probation. The ignition interlock device is a nifty machine that plugs directly into your car and controls your ability to start the car. When you enter the … [Read more...] The post Car of the Future Designed to Detect Sobriety in an Instant appeared first on Minneapolis DWI Lawyer Douglas T. Kans.

Secret police personnel files thwart justice

The other day, Grits described the quandary faced by prosecutors when police departments operating under Texas' civil service code withhold evidence of misconduct that the state is obligated to turn over as impeachment material. This morning I ran across a June 25 editorial from the Beaumont Enterprise describing additional problems with secret disciplinary files. It opened:At a time when the use of force by police officers is under greater scrutiny than ever, the family of Stanley Leger remains trapped in a frustrating dilemma: It doesn't know if it has grounds to sue the city of Beaumont for his death last June ... because the city is withholding much of the evidence that could shed light on the deadly confrontation. That potential evidence includes, incredibly, a video camera taken from Leger's own house on the night of the shooting.Cases like this reveal a gap in the state's Public Information Law that should be closed.Police departments currently…

When the powers that be say it is not working, and th wrong people are on it, what more needs to be said; get rid of it! 11-20-15 Ohio: Title 1 of the Adam Walsh Child Protection and Safety Act of 2006 created an all-inclusive state-by-state registry of convicted sex offenders. Known as the Sex Offender Registration and Notification Act, Title 1 also attempted the impossible: to protect the

Fay Wells And The Police Response

Fay Wells is, by her own description, a successful, educated black woman.  Clearly, she writes well, and her story of mistreatment at the hands of the Santa Monica police department was moving. I heard barking. I approached my front window and loudly asked what was going on. Peering through my blinds, I saw a gun. A man stood at the bottom of the stairs, pointing it at me. I stepped back and heard: “Come outside with your hands up.” I thought: This man has a gun and will kill me if I don’t come outside. At the same time, I thought: I’ve heard this line from policemen in movies. Although he didn’t identify himself, perhaps he’s an officer. There were 19 police officers outside Wells’ apartment. That’s a lot of cops. It would appear that they either have way too many police officers with nothing better to do, or way too little crime and everybody wants in on a potential bust. It seems that Wells’…

Massachusetts Trying News Ways to Keep Drunk Drivers Off Roads

In the neighboring state of Rhode Island, a new law went into effect, which allows a judge to sentence any repeat offenders or drunk driving offenders with a blood alcohol concentration (BAC) of more than two times the legal limit to having to get a vehicle breath interlock device installed in his or her car.   This means that if the driver wants to start his or her car, he must blow into the device and show a clear reading. The device can also require the driver to blow into it whenever stopped or at certain random intervals to prove sobriety. While the Rhode Island law is for repeat offenders and those with extremely high BACs, the Massachusetts legislature is proposing a new law that would require vehicle breath ignition interlock devices for anyone convicted of a operating a motor vehicle under the influence of intoxicating liquor or drugs (OUI), according to an article from ABC News.   For those that are not aware, the Massachusetts uses the term OUI…

After a jury convicted Mickey Wahl of manslaughter and the trial judge sentenced him “to a presumptive prison term of 10.5 years”, he appealed.  State v. Wahl, 2015 WL 6687551 (Court of Appeals of Arizona2015).  You can, if you are interested, read more about the case in the news stories you can find here, here and here. The Court of Appeals begins its opinion by explaining thatin the fall of 2011, victim S.C. was dating Wahl's former girlfriend, Susan. After Wahl's breakup with Susan, he dated Jane, who had previously dated S.C. There was considerable animosity among and between these couples because of their prior relationships with each other. On December 11, 2011, S.C. and Susan were at a bar. Wahl and Jane later arrived at the bar, but only Jane went inside. Susan and Jane got into a physical altercation and went out to the parking lot where the fight continued.Wahl intervened, picking up Jane and placing her in the passenger side of…

On Wednesday November 18, a 29-year-old Downey police officer was shot to death while sitting in his own car. According to news reports at Fox News, Officer Ricardo “Ricky” Galvez, a former Marine, was in plain clothes and sitting in his own vehicle when two men ran up and opened fire on Galvez. News reports state that in all, three attackers were arrested within hours of the shooting, which authorities believe occurred as the result of a botched robbery. The three attackers were 16, 18, and 21 and were reportedly on the lookout for someone to rob when they saw the officer sitting in his car. Lt. John Corina of the Los Angeles County Sheriff’s Dept. said that Galvez had just ended his shift when the attack happened, and that he believed the attackers did not know he was a police officer when they attempted to rob him. Corina did not believe Galvez saw the young men coming toward him. The gunshots were heard by another officer who chased the suspects as they…

By Emily McGranachan, Master of Arts student in Ethics, Peace and Global Affairs at American University November 20th is Transgender Day of Remembrance On the night of July 4 – 5, while people in the United States were watching fireworks, transgender women were brutally attacked in Cali, in southwestern Colombia. In a separate attack on the same night, another group of transgender women were attacked and two were injured, one fatally, after being attacked with knives. The second woman had to be taken to the hospital due to her injuries. As horrible as this violence is, it is shockingly and brutally frequent. As of July 2015, the Santamaría Foundation, a local NGO, documented four killings of trans women in Cali that year, and 68 killings since 2005. Colombia Diversa, a national human rights NGO, had documented 15 killings of trans women as of July 2015 in the country as a whole. Unfortunately, such violence against transgender people is all too common…

Minnesota Plans To Reduce Many Future Drug Crime Sentences

The Minnesota Sentencing Guidelines Commission approved a motion that would reduce prison sentencing guidelines for a variety of drug crime offenses. The approved measure would reduce prison sentences for individuals convicted of first- and second-degree drug possession. First-degree possession sentences would be nearly cut in half, and second-degree offenders could receive probation instead of the current four-year prison sentence. Many people on the commission said they believe the state is currently too harsh on certain aspects of drug crimes. They believe low level users of cocaine, heroin or meth are sometimes receiving the same sentences as major drug dealers under the current structure. “The prior guidelines were too severe,” said Mark Wernick, a commissioner and former Hennepin County Judge. Although the measure has received support from the commission, it’s not a done deal. The changes need to be proposed at a public hearing before receiving a…
