Massachusetts Appeals Court Broadens Scope of Lawful Stop on Vague Description of Suspect

In a recent decision, the Massachusetts Appeals Court appears to have broadened the scope of “reasonable suspicion to stop” a person in circumstances where he did not match the descriptions of the suspect as provided by eyewitnesses. In the case of Commonweatlh v. Johnson, police responded to several 911 calls of shots fired by multiple shooter in a residential area. One 911 caller reported that the shooters were black and or Spanish, one of which ran towards a nearby park. Another 911 caller reported a shooter as a black male who wore a black jacket, a red bandana, and then ran from the scene (without stating even the general direction of flight). Police responded to the area of the park within 3-4 minutes after the shooting. They saw a person that appeared to be walking away from the officer near a dark area. The police officer shined his flashlight on the person and saw him to be a black male wearing a grey hoodie pulled tight around his face. The…

2-12-16 New Hampshire: HB 1153 would prohibit towns or municipalities in New Hampshire from passing ordinances that restrict where registered sex offenders can reside. The bill is being considered by the House Criminal Justice and Public Safety Committee, with a hearing scheduled for Wednesday February 17. Currently, there are no state-level restrictions on where sex offenders may live.

Upon reading the Daily Princetonian’s story of the nightmarish racist treatment of a Professor of African Studies, the first thought that popped into my mind was of the absurd complaints surrounding the Aaron Swartz prosecution. His family, friends and supporters thought the system singled him out for abuse, and constructed a narrative as to why. Except there was nothing whatsoever special about Swartz’s treatment. He was treated as poorly as anyone else, as tens of thousands of people have been treated. The “problem” wasn’t that Swartz was treated differently, but that he was treated the same. They just didn’t realize it. They had no clue how anyone was treated because they didn’t give a damn until it touched someone they cared about. The man said he was roped into an international fraud after striking up a conversation with a group in a Romanian night club. That was back in 2007. The plan didn’t involve physically hurting anyone, simply separating them from their money.  The following year, he was on a flight to Los Angeles, where he was taught how to open phony bank accounts. He was able to return to Romania. From there, federal prosecutors say, he would trick unsuspecting buyers on websites like AutoTrader.com and Craigslist into putting a down payment on a vehicle. Nine years ago today, the first post appeared at SJ.  As of today, there have been 7,641 posts (including this one) here. That’s a lot of posts. In internet time, nine years seems like forever. I never kept count of the number of people I’ve angered, disappointed, infuriated and outraged over the years. On the other hand, some of you have enjoyed SJ and found it somewhat useful. The Pettiness of Divorce

It is amazing how long former spouses can hold a grudge and exhibit pettiness, particularly when one spouse is obliged by court order to make spousal support payments to the other. The resentment that builds up when one spouse believes the other does not deserve to be supported can lead to piddly antics, such as the behaviour exhibited by New Jersey divorcee Diane Wagner, age 57. Ms. Wagner claimed that she did not have sufficient funds to contest her husband’s claim for spousal support so she consented to pay him $744 a month for six years. However, it was apparent that her payments were made begrudgingly as evidenced by the notations she wrote on the cheques, such as “bum”,  “loser”, “adult child support” and she even used the acronym “FOAD”. I was shocked to learn just now that Justice Antonin Scalia died while on a trip to Texas.I knew him slightly.  My wife clerked for him both on the DC Circuit and on the Supreme Court.Public life has seldom seen an intellect of his power.  The country is fortunate to have had his years of service.
