Jessica Yevette Crane of Miami, Florida has been arrested for allegedly running down Michelle James and her two children on a sidewalk in Miramar last Saturday. Witnesses at the scene of the accident claim a silver Infiniti sedan belonging to Crane jumped the curb, struck the trio and fled. James, 37, was taken to Memorial Region Hospital in critical condition. Her children, aged 5 and 3, didn’t have life-threatening injuries. Crane, 39, is charged with three counts of hit-and-run involving serious injury and her bond was set at $40,000. She was released on Monday from Broward County Jail after posting bail. The press did not specify an attorney for Crane. According to the arrest report, several witnesses followed the silver sedan after the accident and saw its driver jump another curb a mile away from the bus stop on South University Drive where James and her children where purportedly struck. Witnesses told investigators that the vehicle’s driver was allegedly…

Fault Lines: Two Judges, No Waiting

There’s been plenty happening at Fault Lines, which I assume that everyone should be totally aware of since you read every post there daily, right? Right?!? You should. And you should subscribe, so you at least get to see every post and realize how much you’re missing. Do it. I don’t ask for much, but do this for me. So no, you won’t do it just because I asked you to? You are so unappreciative and demanding. If that’s not a good enough reason, how about this: Fault Lines is now the only place on the interwebs, ever in the history of man, to be able to read and comment on posts by two (count ’em, two) federal judges. Oh, sure, you know that Senior Nebraska District Judge Richard Kopf writes at Fault Lines. Ho hum, you jaded little suckers say. As if you got to engage with federal judges off the record all the time. But now, double your pleasure, double your fun with… Welcome, Colorado Senior United States District Judge John Kane. Judge…

Check Out This Powerful Drunk Driving PSA

Everybody knows that you shouldn’t drive drunk, but thousands of Americans still get behind the wheel every night after having a few too many adult beverages. One of the biggest problems is that most drunk drivers think “It won’t happen to me,” or “I pay more attention to the road when I’ve been drinking because I know I’m drunk.” With this mentality, it’s hard to wake people up to the dangers of drinking and driving. There are plenty of anti-DUI campaigns out there, but drunk drivers aren’t exactly scouring Youtube to look for videos telling them why they shouldn’t drink and drive. But what if you could take that PSA to them? Better yet, what if that PSA was at a bar, where people are drinking and trying to figure out how they’ll get home? And what if you hit them with words from someone just like them, someone who thought they too were immune from the dangers of drinking and driving? Well, that’s…

By Bo Kalabus www.rosenthalwadas.com; b.kalabus@rosenthalwadas.com 24-hour Jail Release: 214-402-4364 To start with, an Ignition Interlock or Deep Lung Device (DLD) is a portable machine that is installed on the vehicle to prevent the car from starting if it detects alcohol in the driver’s system. In order to start a vehicle with a DLD, the driver must blow into the DLD and the driver’s blood alcohol concentration (BAC) must be below .030. As long as the driver’s BAC is below .030 the car will start. The DLD also requires the driver to blow into the machine every 20 minutes while operating the vehicle, or the car will shut down. Having a deep lung device on your vehicle is a rude awaking. If person accused of DWI is released from jail via a writ bond, a mechanism in Collin County that a allows a person’s bond to be set if they have not seen a magistrate judge, that person will have a hearing before a Collin County Court At Law judge within 10 days to…

Russia: Stop the Foul Play

By Viachaslau “Slava” Bortnik, Chair of Eurasia Coordination Group at Amnesty International USA. The World Ice Hockey Championship is taking place in Russia from May 6-22. It is ironic that the championship started on the day of the fourth anniversary of the Bolotnaya Square events. On May 6, 2012, tens of thousands of people marched through the center of Moscow and sought to gather in Bolotnaya Square in protest of the disputed results of the election in which Vladimir Putin had been re-elected Russia’s President. Most never got that far. Ignoring arrangements agreed upon with the protest organizers, the police sealed off two of the three entrances to the square and narrowed the remaining one. The pressure on the police cordon inevitably grew. When it was eventually breached, with isolated acts of violence, the police proceeded to violently disperse the protest. Over the course of the next few hours, police used excessive and often arbitrary force to restrain…

Penalties For Use Of Personal Identifying Information Of Another (N.J.S.A. 2C:21-17.2) Attempting to obtain a driver’s license, birth certificate, or other government document that can be used to establish your identity through the use of false documents is a serious crime in New Jersey. Under Use of Personal Identifying Information of Another (N.J.S.A. 2C:21-17.2), you can be sentenced to up to 10 years in prison and face fines of up to $150,000 for attempting to defraud a government agency into providing false identification to you through the use of falsified documentation or documents that belong to another. N.J.S.A. 2C:21-17.2 is a crime of a second degree, which means that New Jersey’s presumption of non-incarceration will not apply if you’re convicted, and you can spend years in prison as a result. Don’t take chances if you’ve been charged with Use of Personal Identifying Information of Another in New Jersey. If you or a family member…

Dangled Constitutional Rights: Virginia’s Supreme Court affirms drug conviction despite a police stop despite no dangling object violation

$

In August 2014, I gleefully blogged about a Virginia Court of Appeals opinion that a dangling object does not obstruct one’s view is not a lawful basis for a car stop by police. That glee was dashed when an en banc Court of Appeals, 6-5, reversed and affirmed the drug conviction of Loren Mason, a passenger in a car stopped for no other reason than a parking pass affixed to the vehicle’s rearview mirror and not obstructing any view, and therefore not in violation of the dangling object law. Mason v. Virginia, ___ Va. App. ___ (Feb. 3, 2015). On May 5, 2016, the Virginia Supreme Court, 5-2, also affirmed Mason’s conviction, concluding that the police officer had reasonable suspicion to stop Mason’s car for being in violation of the dangling object law, and stated: “Police officers charged with enforcement of the statute are confronted with a demanding task. Some dangling objects may turn out not to obstruct the…

Super Strong Clear Statement Rules Down Under

Dan R. Meagher, The Principle of Legality and a Common Law Bill of Rights—Clear Statement Rules Head Down Under (2015), available on SSRN. Linda Jellum I decided to think outside the box this year with my recommendation, or more accurately, outside of our Country’s academy. About a year ago, an Australian Law Professor Dan Meagher contacted me about presenting his paper to our faculty at Mercer University School of Law. I’m very grateful that he did. Professor Meagher ended up visiting with us for a week this past fall as a visiting scholar. During that time, he provided one of the best development presentations that I have seen. His topic was interesting yet completely outside of most of our expertise. His presentation style was relaxed and fostered the interaction of the entire faculty. Perhaps the relaxing part should not be surprising: Australians are not necessarily known for being uptight. I chose to recommend his article to Jotwell readers because I…

But For Video: The End Of The Chase (On Live TV)

Is this the usual ending? Hardly. No shots were fired and the person who contemptuously fled didn’t end up dead. Maybe that’s something he should be thankful for, but somehow appreciation for fine law enforcement doesn’t seem quite appropriate, even if it didn’t end in a hail of bullets. As one would expect, the reports begin with why the guy beaten isn’t the sort of person anyone should lose sleep over. The chase began just after 4 p.m. when a suspect, identified as Richard Simone, 50, of Worcester, wanted on multiple warrants including assault and battery with a dangerous weapon and larceny, refused to stop for police in Holden. So he was a bad dude? With warrants? For doing bad things? Maybe? And the relevance of that background to gratuitously beating a guy would be what? From there, the chase wound through Concord, Littleton, Chelmsford, Billerica, Nashua, Hudson and several towns in between. Speeds reached up to 90 mph. It’s…

NPR’s Shifty Push For Well Deserved Public Shaming Of Campus Rapists

$

When District of Columbia councilwoman Anita Bonds came up with her stroke of genius, it was so ridiculously absurd as to serve only as a vehicle for ridicule. Everyone had a good laugh at her insane proposal: Newly proposed D.C. legislation would require colleges to put a permanent and prominent notation on the academic transcripts of students who are convicted of sexual assault or who try to withdraw from school while under investigation for sexual misconduct — a “Scarlet Letter” that would follow them to new schools and graduate programs or into the workforce. But that was a year ago. Back when Congressman Jared Polis laughed off the consequences of campus rape adjudications as insignificant.   Back when lawprof Corey Rayburn Yung argued that the usual punishment was a semester’s suspension, coining “good enough for twitter.” All to the effect of dismissing concerns about the wholesale denial of due process in conjunction with the…
