Kpodi, _ F.3d _ (D.C. Circuit, No. 14-3037, May 31, 2016) A unanimous panel of the D.C. Circuit found error and vacated a 151-month sentence imposed over objection by the trial court, which previously had found the same evidence too attenuated to allow its introduction at trial. Finding the trial judge’s decision an abuse of discretion, and the admission harmful, the Court of Appeals vacated the sentence and remanded the case. The study of predicting which criminals are more likely to commit future crimes has been one of great interest for many years, and it’s given birth to computerized systems in the U.S. known as “criminal risk assessment tools.” Criminologists say there is a public interest in recognizing which individuals may be more dangerous before it is decided how long their sentence should be and when or whether they should be released.  Prior to the 1970s, these predictions routinely factored race, skin color and nationality. The following decade, as the country was in a midst of a crime wave, lawmakers imposed many mandatory minimum sentences and removed discretion from the hands of prosecutors and judges. That meant there was less important to evaluate individual offenders, but then states started grappling with overflowing prisons and jails. Two Arrested For Baltimore County Package Thefts

The Baltimore County Police have reported the arrest of two men in connection with a string of package thefts in a single family home development in Pikesville. Residents in the area of Smith Avenue and Greenspring Avenue have been noticing missing packages for the last couple of weeks, but many never suspected wrongdoing. Some residents even took notice of a suspicious vehicle driving slowly through the new construction development, but did not make the connection to missing packages.  Eventually the area residents and the county police caught wind of the ongoing conspiracy and went on high alert, and their vigilance paid off. Two suspicious men in reflective vests were reportedly seen removing packages from the front porches of houses, and then leaving in a dark colored SUV. Information about the dark SUV spread quickly, and when the men returned a neighbor followed them to get a closer look at the license plates. Armed with the license plate information it was only…

  Proposed Louisiana law seeks to further erode privacy of sex-offender registrants   The Louisiana State Senate on May 24 passed House Bill 1146, which aims to give the public access to email addresses and online screen names of registered sex offenders. House members passed it earlier in May. The impetus behind the bill, which won unanimous approval of both chambers with support of Democrats and Republicans alike, is unclear. State Rep. Cameron Henry, R-Metairie, who sponsored the legislation, has told The (Baton Rouge) Advocate that the bill is aimed at helping parents keep their children away from sex offenders when they play video games or participate in other online activities. The bill seeks to allow “limited disclosure” of the information to those who request it as a way of identifying and monitoring registered sex offenders. However, the proposed law, which awaits Gov. Police Chase Suspect Into Backyard Hot Tub A 29-year-old Anaheim man was arrested after Placentia police chased him into an Anaheim neighborhood and then discovered him hiding in a hot tub in the backyard of a residence. The incident began around 5:00 a.m. when police attempted to pull over an individual in a Mustang. However, the driver ignored the officers’ instructions to pull over. At some point, a passenger in the Mustang jumped out and was detained by the officers, as the Mustang continued driving southbound on Kramer Boulevard and onto the westbound 91 freeway. There aren’t very many federal cases about North Carolina probation. When we get one, I’m inclined to write about it. In Jones v. Chandrasuwan, __ F.3d __ (4th Cir. 2016), the Fourth Circuit announced a new rule about the level of suspicion required to arrest a probationer for a suspected probation violation. Stanley Jones pled guilty to indecent liberties with a student in 2010. He was sentenced to 24 months of supervised probation and ordered to pay costs and a fine pursuant to a schedule set by his probation officer. He transferred supervision from North Carolina to Georgia under the Interstate Compact for Adult Offender Supervision. As his probation neared completion, an administrative review by North Carolina revealed that Jones hadn’t paid any of his money. A North Carolina officer eventually prepared a violation report, alleging the monetary violation. When mail to Jones’s Georgia address was returned undelivered, the officer also alleged an…

Do I Need An Attorney if I Get Arrested for a DUI?

There is little doubt that most of us know someone who has been arrested for a DUI.  Driving Under the Influence (DUI) is one of the more common misdemeanor cases that appear in criminal court.  While great strides have been made to reduce the number of alcohol related arrests, there seems to be an increase in the number of drug related DUI’s.  That being said, do individuals who get arrested for alcohol and drug related DUI’s need an attorney? While it my not be a popular answer to our peers, the best and most honest answer is “no.”  Driving Under the Influence is statutorily driven, meaning the punishment is usually the same for everybody.  For first time offenders, unless there are extenuating circumstances, (lack of probable cause for the stop, an accident, high BAC level, or lack of cooperation with law enforcement) there is typically no jail time.  In addition there are standard fines and fees for conviction,…
