As we have discussed in the past, the authorities have been working very hard to dispel that belief. Take Robert Scatamacchia (hereinafter, the “Defendant”) for example. The Defendant is not the type of man you would expect to see either at the defense table in court or wearing the appropriate garb in a Massachusetts prison. But now, he has done both. According to the Boston Herald , the Defendant is a former Haverhill, Massachusetts city  councillor. He was also a business partner in a funeral home business.   On Tuesday, the Defendant pleaded guilty in Lawrence Superior Court to stealing more than $270,000 from his business partner and customers of the funeral home. The 66-year-old Defendant was sentenced to one year in prison as well as five years…

7 Charged for Aiding FL Murder Suspect's Escape:  Several people have been charged as accomplices for assisting a Florida murder suspect and death row inmate escape from a crowded courtroom last Friday.  The AP reports that Francine Mesadieu, 31, provided prisoner Dayonte Resiles, 21, with a wig, clothes and colored contact lenses to disguise himself, while Paige Jackson, 18, helped to plan the escape through three-way jail phone calls.  Resiles was sitting in the jury box when he slipped out of his shackles, jumped a courtroom barrier and ran past two unarmed bailiffs towards downtown where a car was waiting for him.  Fellow inmate, Walter M. Hart II, 22, has also been charged for holding Resiles' shackles while he manipulated them along with Resiles' girlfriend, LaQuay Stern, 18, who was driving the getaway car.  Resiles has been rearrested.  Sheriff Scott Israel stated that armed deputies will now accompany maximum-security…

What Exactly can be Obtained Through a Gramma Request? One can obtain even individual financial records through a GRAMMA request. Article I, section 14 of the Utah Constitution prohibits state actors from conducting unreasonable searches and seizures. The state can seize evidence without violating section 14 if it uses a valid warrant or subpoena. In Shroeder v. Utah Atty. General’s Office, 2015 UT 77 David Schroeder filed a public records request under the Government Records Access and Management Act (GRAMA). He was seeking bank records the state had seized lawfully during a criminal investigation that arose from the City raising funds that were intended to promote the City as a destination for tourists and entrepreneurs, but instead they used a significant amount of those funds for expenses in support of local political campaigns. In Commonwealth v. Robinson, the defendant was convicted of two counts of uttering a false check. The defendant came into a bank in Cambridge in 2011 and presented a check at a teller window. The $8,539.29 check made out to Bonnie Green was to be deposited into a savings account held by Bonnie Green. It was drawn on another bank account held by the Clark S. Binkley Company. A few days later, the defendant withdrew money from Bonnie Green’s savings account. On the same day, the bank from which the check had been drawn returned the check and marked it as an altered fictitious check. An investigator for bank fraud found that the other bank hadn’t returned the check, based on insufficient funds. He obtained surveillance footage associated with the deposit. A few days later, the defendant came to another bank branch and presented a check to be deposited into Megan Neilson’s bank account for over $8,000. It was drawn on a company account at another bank. Sacramento District Attorney Anne Marie Schubert has this op-ed in the Sacramento Bee, responding to an earlier piece by Ron Briggs.  Unfortunately, it is behind the Bee's paywall.The reason that no executions have occurred in California for 10 years is the state's delay in drafting regulations for a method of execution. If you’ve been following the news, you may have heard about the alleged “exotic car” speeding case. According to police, a dozen drivers in exotic cars topped over 100 miles per hour while driving from the west metro to a gas station in Maple Plain. Two of those individuals charged in the case were Alfredo Santiago of Andover and Gholam Hossein Vatanioskooi of Victoria. When Santiago and Vatanioskooi were charged, they did the smart thing and hired an attorney. Even better for them, they hired Appelman Law Firm.
