Short Take: This Is Your Court On Drugs

If you squint hard enough, you could see the unicorns prancing in the rainbow well. Where was this miracle happening? Drug courts. It had the two things that make for a spectacularly successful pitch. First, the theory played into the visceral desire to help people who desperately needed help. Second, it fit neatly on the little piece of paper gently foldable within even the smallest fortune cookie. Drug courts. What could be bad? Putting aside the price of admission, forfeiture of constitutional rights, maybe innocence and occasionally a few well-placed “distraction*” punches to the face while a gaggle of blue sit on your back to crush the air from your lungs, isn’t it worth it if addicts finally, finally, get treatment? Also put aside that if there’s anyplace in the world where drugs are not just readily available, but ubiquitous, it’s a drug treatment facility. It’s the Willie Sutton theory, that’s where the addicts are. But you…

The New Hostess With The Mostest

As of yesterday, SJ has changed hosts from A2Hosting to Fused. There may be some bugs to work out along the way, because technology is wonderful and fixes everything. If you see a problem with SJ, please let me know. That doesn’t mean I’ll know what to do about it, but at least I can try. And immediately after the switch, I lost the capacity to access the SJ dashboard. After an intriguing discussion about equality v. freedom, Jake came to my rescue and helped me fix this vexing problem. Thanks, Jake. At the moment, I’m having a bit of an issue here, with SJ pages rendering in a lovely but unreadable shade of blue. Whether this is happening to you, I dunno. I’ve already sent an email to my new host, and if anybody reading actually knows* why this is happening, I would appreciate hearing from you. There will be bugs. I will keep trying. Bear with me, please. *As in, you actually know how to birth babies. Copyright © 2007-2017 Simple Justice NY, LLC…

White House backing for methadone in jails?

I don't understand the Trump Administration's position on the Drug War at all. Grits was under the impression that "beleaguered" Attorney General Jeff Sessions was ramping it back up, but then we see that the Administration apparently supports methadone treatment for addicts in county jails. From the New York Times:maintenance treatments like methadone, if uninterrupted, are proven to reduce arrests and increase employment, and for many with addiction are the only thing that works. In July, a White House commission on opioid addiction called for increasing inmates’ access to addiction medication.Somebody help me out here, I can't keep track any more: is that a liberal or a conservative position?Grits also wanted to flag a medication being used on addicts in jails (or more often, as they are discharged), of which I hadn't previously heard:A growing number of jails, especially in rural areas, have opted to treat inmates not while they are in…

Woodward Avenue is host of the Annual Dream Cruise which draws thousands of car enthusiasts and their vehicles all summer long. Many of those vehicles make more noise than others and sometimes their owners do it purposely. They rev their loud engines and squeal their tires on the pavement to the amusement of those who appreciate and delight in their beautiful machines. Unfortunately, there are many residents that live close to Woodward and are disturbed by the vehicle noise. Some have a right to be upset because some of the vehicles, and their drivers, are in violation of the state vehicle noise ordinance. Many other vehicles are not in violation but people complain anyway. City of Royal Oak’s Unlawful Ordinance The City of Royal Oak, which is centrally located during the Dream Cruise, received complaints from these residents. They also heard complaints of the motorcycles that frequent downtown Royal Oak on Wednesday and Thursday evenings. In response to the complaints,…

South Florida DUI Manslaughter Trial Ends in Plea Deal for 9 Years

$

A South Florida man has been sentenced to nine years in prison on DUI manslaughter charges after accepting a plea deal to avoid harsher prison time after a fatal crash that claimed the life of an 85-year-old dentist. The Palm Beach Post reports defendant will have to serve at least six years in prison following his release from prison. The last-minute deal halted the impending trial, which could have resulted in defendant receiving up to 15 years in prison, per F.S. 316.193. DUI manslaughter in Florida carries a minimum mandatory penalty of four years in prison, with a maximum of 15 years. This maximum penalty could be increased if the individual also flees or tries to flee the scene. In that case, it’s considered a first-degree felony, carrying a maximum 30 years behind bars. Having an experienced defense lawyer can help increase your odds of a favorable outcome – or at least minimize the chances of spending more than a decade behind bars.  There are a number…

Mary Jane + Rider Refrain = Jury Constrained. United States v. Kleinman, 895 F.3d 825 (9th Cir. 2017), decision available here.Players: Decision by Judge Milan Smith, joined by Judge N.R. Smith and visiting Tenth Circuit Judge Ebel. Facts: Kleiman ran California medical marijuana collectives. Id. at 830. The government alleged that a majority of the sales were done outside of the storefronts, unlawfully, using techniques found in “normal” illegal drug distribution conspiracies. Id.   The case was dismissed stateside after Kleinman asserted the protections of California medical marijuana laws -- the feds then picked it up. Id.   The district court emphasized during jury selection that the jury could not question any purported conflict between federal and state law on medical marijuana, and should consider the case under federal law only. Id. at 831. Kleinman was convicted after trial, and sentenced to 211 months. Id.   After the conviction…

Overtime for police court appearances a growing cost driver at Austin PD

$

Last month, a Grits post highlighted provisions in the Austin and Houston meet and confer contracts which gave officers extra pay for time they spend testifying in court. In Houston, courts found this gave officers an incentive to make arrests on bogus DWI cases so they could make extra money - often quite a bit more than their base pay - in overtime for court appearances. And Austin's overtime pay for court appearances is even more generous. Now, a budget response to questions by Austin Mayor Steve Adler about the drivers of overtime expenditures and police budget costs supplies light on the subject from a different angle. According to the city manager's response,In 2016, overtime per sworn officer at APD was $11,647, up from $8,108 per officer in 2014.Adler asked what was driving costs and overtime use at Austin PD. Looking beyond base officer pay, which in Austin steps up quickly with seniority to make them among the highest-paid officers in the state, the biggest…

Prosecutorial Misconduct: A Continuing Blight on The Criminal Trial Process

Emily Bazelon is a staff writer at The New York Times Magazine and is the Truman Capote Fellow for Creative Writing and Law at Yale Law School. She recently published an exhaustive article about prosecutorial misconduct in the Times Magazine. This article focused on Shelby County, Tennessee’s District Attorney Amy Weirich and a murder case she prosecuted as an assistant district attorney.   According to Ms. Bazelon, in June 2005, Weirich was a 40-year-old “rising star” in the Memphis district attorney’s office when she was assigned to prosecute 18-year-old Noura Jackson who had been charged with the murder of her wealthy mother. Weirich was the first female deputy district attorney in Shelby County and had earned her reputation as “a highly skilled trial lawyer” while chief of the gang-and-narcotics unit in the DA’s office.   Win at All Cost Ambition, Prosecutorial Misconduct   But like many successful prosecutors,…
