Day Care Worker Facing Charges After Child Dies in Parked Van

A horrific tragedy earlier this month reminds us that a vehicle can quickly become deadly on a hot day. Last week, the body of three-year-old Myles Hill was discovered in a parked van at the Little Miracles Academy day care center in Orlando. The little boy, along with several other children, had been transported from one of Little Miracles’ locations to another. When the child was found, authorities believe he had been in the van for nearly 12 hours. According to police reports, Myles’ grandmother called the center when he didn’t get dropped off in the afternoon. Employees reported that the child had never been seen at the center that day, prompting an immediate investigation into his whereabouts. At about 8:30 that evening, Myles was found on the floor of the van, which had been parked at the center since 9:00 a.m. Outside temperatures had reached 93 degrees that day. The Second Circuit recently considered the extraterritorial application of the U.S. securities laws in the private securities class action context, bringing some clarity to an area of the law that is increasingly important given the globalization of financial markets. What is a Motion for Directed Verdict in a Criminal Trial?

As the close of the prosecution’s case, a Defendant can request the court for a directed verdict in his or her favor.  What is a directed verdict?  Michigan Court Rule 6.419 indicates that during a criminal trial the defense or the court on its own  volition can consider after the prosecution rests or after the close of all evidence whether or not the evidence is sufficient to support a conviction.   The standard that the trial Court uses in this determination is to consider whether or not, in the light most favorable to the prosecution, that a rational Judge or jury could find beyond a reasonable doubt that the Defendant is guilty.  See People v Smith-Anthony, 494 Mich 669 (2013).  Hence, if this standard is met, there is a judgment entered in favor of the Defendant without any Judge or jury deliberations. Carlsbad Pastor Arrested on Child Molestation Charges

According to news outlet ABC 10, a Carlsbad pastor named Matthew Tague, 43, has been arrested on 16 counts of child molestation. Deputies with the San Diego Sheriff’s child abuse unit has charged him with lewd and lascivious acts with a minor under the age of 14. The charges against Tague, a pastor at North Coast Calvary Chapel in Carlsbad, are not related to his duties as a pastor. Tague is currently being held in Vista Detention Facility on $1.9 million bail. He was due in court on June 2. Once he appeared in court, he pleaded “not guilty” to charges of repeatedly molesting a female member of his congregation for two years. He also pleaded “not guilty” to charges of 14 forcible sex acts against a child. Additionally, Deputy District Attorney Patricia Lavermicocca said Tague is accused of violating a family member when s/he was 12 and 13 years old.
