Despite California’s strict laws concerning driving under the influence, the state’s number of DUI arrests remains fairly high. According to the Annual Report of the California DUI Management Information System for 2015, there were more than 172,000 DUI arrests in 2012 alone; 73.8 percent of these were first-time offenders. Here in Los Angeles, law enforcement is known for its aggressive pursuit of DUI, with increased numbers of sobriety checkpoints. Some reports estimate as many as 100 people per day are arrested for DUI in Los Angeles County. Moreover, year after year, the conviction rate for California DUI arrests hovers around 73-75 percent. Because three-quarters of arrests resulting in convictions, more than 120,000 California drivers a year will face long-term repercussions for their first DUI offense—and those who live in L.A. have a greater chance of being caught than in other parts of the state. Under California law, “driving under the influence” (DUI) doesn’t just apply to alcohol. It also encompasses the use of any drug that may impair your ability to operate a vehicle. That includes illegal drugs, prescription drugs or over-the-counter medications. In other words, if an officer pulls you over and suspects you are impaired due to the use of drugs—even those you’re legally allowed to take—he can still arrest you under suspicion of DUI. Most of us understand the dangers of combining alcohol with driving, but statistically, far fewer people understand or recognize prescription drugs’ effects on our ability to drive. A crime known as “jugging” is making headlines in Texas in the weeks leading up to the holidays. The news channel CBSDFW noted people are being robbed of their holiday crash in some of the larger cities in Texas. Police say criminals are watching people when they go to ATMs to get out holiday cash, following them and seizing the money. Carrollton Police report at least nine incidences of the crime over the last few months. The victims are also being targeted for documents containing their personal information, according to reports. CBS spoke to a victim called John who was inside a Chase Bank in Addison for about an hour. When he left, he carried a bank receipt and left it in in the glove box of his car. Police said he was being watched. After a quick workout, he went back to his car and saw broken glass on the ground. He said he realized the thieves had broken into his car and left behind a phone charger, sunglasses and other items. Arson Charges in Arizona

In a recent Arizona arson case, the defendant was convicted of arson of an occupied structure and criminal damage. He was sentenced to concurrent prison terms, and the longer term was 10.5 years. The appellate court explained that in 2013, the victim’s neighbor called 911 due to the house next to his being on fire. The victim was a family trust, and the defendant was staying there while renovating it. The carport was involved in the fire, and a truck was destroyed. While putting out the fire, the firefighters found other fires had been started in the house. The truck was blocking the door, and the front door was blocked, so the firefighters pushed into the house. It seemed nobody was inside, but in a second search, a firefighter saw that a bathtub full of water had a hose pushing out from the water in a nearby window. Last week, I had the opportunity to help provide training to Mexican criminal justice professionals. The training included Mexican police, prosecutors, and forensic experts from multiple jurisdictions. I learned a great deal, and thought I would share my impressions briefly for those who are interested. The former Mexican system. Mexico’s criminal justice system used to be very different from ours. The old system has frequently been described as a “mixed inquisitorial” system, situated generally in the European civil law tradition, yet with many distinctive features. Police were mainly dedicated to crime prevention, like security guards, not to investigation. Prosecutors directed investigations and questioned witnesses. Prosecutors also filed and prosecuted cases. Cases were decided by judges based primarily on written affidavits. Oral testimony subject to cross-examination was rare. FINRA Continues to Prioritize Examinations of High-Risk and Recidivist Brokers

In its 2017 Regulatory and Examination Priorities Letter, FINRA made clear that one of its top priorities is identifying high-risk brokers and ensuring that their firms properly monitor them. To assist it in doing so, FINRA has established a dedicated examination unit to identify and examine brokers who may pose a high risk to investors. That unit’s charge is also to (1) review firms’ supervisory procedures for hiring or retaining statutorily disqualified and recidivist brokers; and (2) evaluate firms’ branch office inspection programs and supervisory systems. California Man’s ‘Shaken Baby’ Conviction Reversed

A California man was released from prison Saturday after a Superior Court judge reversed his murder conviction in relation to the 2001 death of his infant daughter. Northern California Innocence Project client Zavion Johnson was convicted in 2002 for the murder of his four-month-old daughter, which he maintains was an accident. During the trial, Johnson testified that the child slipped from his hands into the tub as he was bathing her. Fifteen witnesses, including the baby’s mother, testified that he was a loving and attentive father. But medical experts testified that the child’s injuries were evidence of abuse. Johnson was found guilty of second-degree murder and sentenced to 25 years to life in prison. After a recent review of the evidence, experts—including the pathologist that testified at Johnson’s trial—agree that the child’s injuries are consistent with the fall he described 17 years ago. Programs Saving More Sex Trafficking Victims In Minnesota

Research into Minnesota Safe Harbor program revealed that more sex trafficking victims and sexually exploited minors are getting help than in years past. According to the data, 1,423 children and young adults received treatment or housing through the state’s Safe Harbor program between 2015 and 2017. That number is up 359 over a one-year period from 2014-2015 when the program was first evaluated. The increase can tell two different stories. For starters, it’s great that more children and teens are getting the help they need to escape the sex trafficking trade, but it’s also concerning that this many more people need help, suggesting that sex trafficking is still a huge problem in Minnesota. Sex Trafficking Statistics Here’s a closer look at some of the other findings from the study: Hennepin County, St. Louis County and Olmsted County are the top three counties for Safe Harbor Referrals. At Tenn And Tenn, P.A., we know that motorcyclists deal with legal issues that are far different from a car driver. At face value, the case of Ryan Austin Collins seemed simple. When a speeding, orange and black motorcycle evaded pursuit, Virginia police officer David Rhodes managed to log the plate number of the bike. Later, an informant led Officer Rhodes to a residential house, where he found the motorcycle in question beneath a tarp. Blurring the Lines of Legality, Privacy and Citizen’s Rights The incident that followed has merited the attention of the United States Supreme Court, to determine whether what transpired infringes on Collins’ Fourth Amendment rights. Upon lifting the tarp and running the motorcycle’s VIN number, Officer Rhodes was able to verify that it had been stolen in New York some time prior.
