While molestation charges are very serious, especially when it involves a minor child, there are also many cases where a person is falsely accused of a crime they did not commit. Sadly, false accusations are quite common and can wreak havoc on the life of the individual who has been wrongly accused. If you have…

Ike Luong will serve six months in the county jail. That time behind bars will be followed by five years of probation — supervision — for his conviction of second-degree sale of drugs. Luon, 56, of Las Vegas was stopped by Minnesota’s State Patrol for a busted taillight. When law enforcement searched his car, they found 130 pounds of pot in his car. Luon figured a plea deal would be best. His cooperation knocked down a first-degree sale of drugs and wiped out a first-degree drug possession charge. The Judge, Gordon Moore, gave Luon a stay from prison but fined him $1,000. Luong, who must report to jail by June 4, but could get work release if he finds a job. The Judge admitted he wrestled with the sentencing since there was no context for someone in Luong’s situation. Luong didn’t have any prior felonies and was a veteran of the Nevada National Guard. “Usually when we sentence someone, Moor said, “we look at what the court did the last…

The New York Police Department’s explanation that more Hispanics and Blacks are arrested on pot charges because complaints are higher in their communities doesn’t hold up. While there are many ways to get detained on pot charges, one pattern has stayed true through decades of policy changes in the city: The primary targets are blacks and Hispanics. Visit almost any courtroom in the city, and they fill the pews. Black, young men, waiting to talk to a judge about a crime that isn’t a crime in many states: possess marijuana. The young men talk about smoking in a housing project hallway or being in a car with a friend who was smoking. Throughout the city, blacks are arrested on low-level charges at eight times the rate of white, non-Hispanic persons over the past three years. The New York Times found Hispanic persons were arrested at five times the rate. Go to Manhattan and the chasm is even bitter. There, blacks are arrested at 15 times the rate of whites. Even…

James W. Coleman, How Cheap is Corporate Talk:? Comparing Companies’ Comments on Regulations with Their Securities Disclosures, 40 Harv. Envtl. L. Rev. 47 (2016), abridged in 47 ELR 16081 (August 2017). Robert Rosen It doesn’t take masses of data or high-powered statistics to generate important results. It takes a good question. James Coleman asks one and thoroughly massages it for insight. Corporations exercise their speech in multiple audiences. Marketing addresses consumers. The Human Resources Department addresses employees. Coleman focuses on corporate speech to the SEC and the EPA about the proposed Renewable Fuel Standard between 2009 and 2013. The number of corporations whose statements in the rule-making procedure and in their annual reports can be compared are small. In 2009, Professor Coleman studied 33 corporations and only 11 in 2013. The small number is not as significant as the lessons we learn when we compare what is said to these two…

For some seniors in the baby boomer generation aging brings with it new challenges in the form of solo aging. Solo aging is a senior who has no children and no younger (or healthier) family members to assist them as they age. As in generations before, baby boomers are living longer and healthier lives but for some there is no escaping the eventualities of disease like heart disease, arthritis, diabetes or dementia. Others may require extensive care following a fall that results in a broken hip or other serious injury. In prior generations when an aging senior needed assistance with activities of daily living they would typically enter a residential facility or be treated at home, often times with a younger family member to supplement their needs. In the case of the baby boomers however, healthy family members who can provide care are in shorter supply. Solo aging requires a modified approach to the requisite standard planning around the larger family system of previous…

Long-term care costs can be staggering and may continue to rise. A failure to plan for long-term care could end up derailing your estate plan. Imagine what could happen if you or your spouse require several years or more of care in a nursing home or assisted living facility. According to the American Association of Long-Term Care Insurance, an average assisted living facility in North Carolina costs $2,000 per month. Nursing homes are even more expensive. If you’ve spent your life working to acquire assets and created an estate plan to take care of your loved ones, you should be concerned about how long-term care expenses could deplete your assets.
