In 2014, an Illinois state arbitrator awarded workers’ compensation to an Illinois State Trooper as a result of his suffering from Post-Traumatic Stress Disorder. What made the case unusual was the source of the PTSD was an allegedly abusive supervisor. The trooper claimed he was suffering mental and physical anguish because the supervisor had constantly berated him while he was under the supervisor’s command. However, the decision was later overturned during an appeal. Workplace stress can gradually degrade an employee’s mental health, but the Illinois Workers’ Compensation Commission is unlikely to recognize this as a reason to award compensation. Specific Trauma Illinois claimants can receive workers’ compensation benefits for PTSD if they can site an event that caused the trauma. An event usually involves the claimant: Being the victim of a violent attack; Suffering a severe injury at work; or Witnessing a disturbing scene at work. Police…

From kitchen appliances and HVAC systems to wheel chairs and other medical devices, the California Lemon Law applies to almost every product purchased for personal use other than clothing, food or other consumable goods. Naturally, no one buys a washing machine or computer with the expectation that it will be defective in some way; you expect the things you buy to function as they should. School Bus Driver Pleads Not Guilty to Allegations of Abusing Autistic Child

In early February an incident between a school bus driver and an 8-year-old autistic child was captured on video displaying the driver mocking and putting her hands on the child. The video was publicly released, and the driver is facing criminal charges. 64-year-old Kim Cheryle Klopson drives a school bus for the Vacaville Unified School District in Vacaville, California. On the morning of February 6, she was charged with driving the special needs children to Browns Valley Elementary School. While the bus was en route to the school Klopson reprimanded an 8-year-old autistic girl who was on board and allegedly told her that if she continued to block the aisle with her feet she was “going to be on the window,” as heard on the surveillance equipment installed inside of the bus. In Moser, the Superior Court concluded that police lawfully obtained the defendant’s blood sample without a search warrant because the defendant consented to the blood draw before police read him defective and coercive O’Connell warnings.
