What Does It Mean to Be Charged with Mayhem? Everyone is familiar with the word “mayhem,” but fewer people are aware of the concept of mayhem as an illegal act. According to NRS 200.280, mayhem is defined as “unlawfully depriving a human being of a member of his or her body, or disfiguring or rendering it useless.” Thus, charges of mayhem in Nevada can cover many injuries. A person who gouges out someone’s eye, disables a person’s tongue or bites off a portion of someone else’s nose may be guilty of mayhem. However, they must commit the act with malice. This requirement doesn’t necessarily cover the intention to maim another person in Las Vegas. If the defendant behaves in a way that makes disfigurement a natural consequence, then the court simply presumes that malice was present. In addition to malice, mayhem charges in Las Vegas must cause a permanent injury. NRS 200.300 states that when an injury is only temporary and is likely…

Prosecutors decided to drop charges against NFL free agent Chris Johnson this week for a January gun arrest in Orlando, according to court records. The Orange-Osceola State Attorney’s Office stated that, “this case is not suitable for prosecution.” The 29-year-old athlete was stopped on the night of Jan. 9 for running a stop sign while driving with a friend, when an Orlando police officer noticed a pistol on the floor between Johnson’s feet, according to reports. The weapon was apparently a 20-shot Belgian pistol that fires a high-velocity 5.7 mm bullet that can pass through tactical vests worn by police officers. These handguns are legal to own, but police claim that Johnson also had a 9mm Glock pistol in a backpack next to his feet. An eighteen year old Jupiter man, Daniel Leneve, was arrested last week after a naked, drug-fueled rampage through a house, shouting that everyone in the house was going to die. Leneve and his seventeen year old girlfriend of six months had both taken LSD. According to a witness, he tossed his girlfriend around in the backyard, then went inside, took his clothes off, and started smashing things. Sheriff’s deputies were called to the house, and when they tried to handcuff him, he struggled. During the struggle, Leneve’s girlfriend stuck her finger in his face, and he bit it. Leneve was charged with domestic battery, resisting an officer with violence, criminal mischief of $200 or less, and child abuse without great bodily harm. He was released from the Palm Beach County jail on bond. Andrew Skier Quoted in Wall Street Journal Article About Identity Theft

I was recently contacted by a reporter from the Wall Street Journal who was working on a story about inmates in state prisons having their identities stolen while they are incarcerated. I was quoted in his article and there is a brief discussion of United States v. Bryant Thompson, a case I tried in the Federal Court for the Middle District of Alabama a little over a year ago. Identity theft causes problems for the inmates because it adds one more obstacle to overcome in making their transition to the free world. My main point during the trial and in the article is that the Alabama Department of Corrections is negligent in the way they protect the PII (Personal Identifying Information) of the prisoners they are supposed to be caring for. At Skier & Associates we are experienced in helping people who have had their identities stolen as well as representing those accused of Identity Theft in both State and Federal courts.

Reporters seem to be infatuated with the word "botched" when it comes to executions.  This word choice has an unwarranted and detrimental effect.  Cameron McWhirter has this article in the WSJ, referring to the postponed execution of Kelly Gissendaner in Georgia as "a botched attempt."McWhirter has it completely backwards.  When the execution drug was found to be cloudy, Georgia officials prudently postponed the execution precisely so that there would not be a "botched" execution.Let's get it straight, folks.  There has only been one "botched" execution in recent times, that of Clayton Lockett.  Other executions, where an unconscious inmate's body struggles for breath, have been uncomfortable for observers to watch, but the inmate still died a less painful death than most of us are going to have.

According to an article by Capital, edits to these pages have been traced back to computers operating on the NYPD's network at One Police Plaza in NYC. The NYPD is supposedly looking into it, although, if the info concerning the network domain is accurate, then it's pretty cut and dried.I am assuming that the allegations are true. Not so I can wag my finger and shake my head in consternation. At least not this time. There's nothing particularly shocking about a city agency trying to control the public narrative. Manipulating Wikipedia pages -- which readers ought to know often offer questionably accurate factual information -- is old hat. Willy O. Benjamin, 55, of Gordon, GA, was driving a Kenworth tractor pulling a Reitnouer trailer when the cab caught on fire. Benjamin drove the vehicle onto the right shoulder of the roadway.
